S.444 Education Act FPN / Prosecutions

We're waiting for Sara Goode to read recent responses and update the status.

Dear Warwickshire County Council,

I write in connection with the statutory offences in S.444(1)/(1A) of the Education Act 1996.

Can you please provide me with the following information. Please break down the information by school. and further by school year for the years 2013-2014, 2014-2015.

1) How many referrals to the ACE team were made.
2) How many FPN's were issued?
3) How many of these FPN's were rescinded / cancelled.
4) How many FPN's were paid
5) How many were not paid (it should be 2 - (4 +3) but it may not be?)
6) Of those FPN's unpaid, how many prosecutions were attempted?
7) How many prosecutions were successful?
8) How many prosecutions did the council fail to acheive?
9) What was the total revenue from FPN's (per school / year)

I would appreciate the results of this request in an excel document, where possible in the format:

Would you be able to confirm what this short delay will be because of, also can you confirm how long this short delay will be, because at present the best guess I could make is as long as a piece of string...

I believe that this delay would mean that your handling of my request has failed to adhere to s.1(1)(a), s.17, s.10(1) of the foi, as there appears to be no lawful excuse for this proposed delivery of a satisfactory response.

Can you please review your response.

It was late, relied on inaccurate exemptions, and is factually flawed.

I'm told by your staff that each child's record is stored in individual school folders.

So please review the response, because s.12 is certainly not engaged, and if it were, s.16 required you to assist me to reduce the burden upon your authority so as to bring the cost down.

I note that you haven't provided any time estimates, but certainly given the figures, it's clear it wouldn't exceed 18 hrs to respond...

which I apologise.  This matter has been assigned to Legal Services for

As per the recommendation set out in the review, please find attached the
outstanding information in the format you required.  We have combined two
of the columns where this was logical to do so and trust this is
satisfactory.  Please note that some of the figures (when totalled up) may
now vary from the overall figures you previously received as those were by
annual year as opposed to school year.  Aside from this, there was an
additional question that you asked (no.10) about the costs of running the
ACE service per a year which we answered previously.

They've lied... A fpn referral was made by Newbold and Tredington for two patents
Once in 2015 and once in 2016... They've clearly lied. I've got letters from wcc confirming that they wouldn't prosecute etc so certainly a fpn was referred.

And certainly didn't pay any fpn.
