Dear Hampshire County Council

This FOI request relates to aftercare services for patients detained compulsorily under The Mental Health Act 1983 at hospitals run by Southern Health NHS Foundation Trust after their detention ceases, including whilst they remain under the care of a community team.

Under s.117(1), local social services authorities ("LSSAs") and clinical commissioning groups ("CCGs) (acting together) are obligated to provide aftercare for such patients.

Under s.117(2), LSSAs and CCGs (acting together) are obligated to provide aftercare until such time as they are satisfied that the person concerned is no longer in need of such services. This includes those who cease to be detained in hospital but remain as community patients.

I request the following information for calendar years 2016, 2017, 2018, 2019 and the first 9 months of 2020. Alternatively, if easier, please use the equivalent financial years and the first 6 months of 2020/21.

1. How many patients detained under section 3 have been discharged from aftercare services by Hampshire LSSA?

i) Immediately they cease to be detained in hospital.

ii) After discharge by an Acute Mental Health Team following detention in hospital.

iii) After discharge by a Community Enhancing Recovery Team following detention.

iv) After discharge by a Community Mental Health Team following detention.

v) Who at Hampshire LSSA are responsible for liaising with CCGs and determining when aftercare is no longer needed: job titles and qualifications please?

To avoid the risk of duplication, these questions relate solely to patients’ final discharge from aftercare services. They do not relate to discharge from individual teams at the Trust.

2. How many patients admitted to hospital - under a hospital order under section 37; transferred to a hospital by a hospital direction order under section 45A; or a transfer direction order under section 47 or 48 – have been discharged from aftercare services? Please provide just a total figure for these sub-categories.

i) Immediately, they cease to be detained in hospital.

ii) After discharge by an Acute Mental Health Team following detention in hospital.

iii) After discharge by a Community Enhancing Recovery Team following detention.

iv) After discharge by a Community Mental Health Team following detention.

v) Who at Hampshire LSSA are responsible for liaising with CCGs and determining when aftercare is no longer needed: job titles and qualifications please?

I repeat the previous qualification about the risk of duplication.

Dear Hampshire County Council

I am writing to request an internal review of Hampshire County Council's handling of my FOI request 'S.117 (of the Mental Health Act 1983) aftercare services'.

This follows my telephone conversation with Rob Drew this morning. For ease of reference, I have sent him a copy of s.117 of the Act. An internal review is requested because:

1. It is almost inconceivable that Hampshire County Council has not discharged anyone from s117 aftercare in 4 yrs. 9 mths.

2. Please clarify the meaning of 'not applicable'. Is it not applicable because:
i) It is covered by the overall asnwer that no-one has been discharged from s.117 aftercare or
ii) HCC does not believe that it's their respinsibility.

If indeed HCC has not discharged anyone under s117 aftercare in that period, please provide the number of persons under s.117 aftercare at the end of each year from 2016 to 2019 and at the end of the first 9 months of 2020. (If there have been no discharges, the year-on-year total will be accumulative.) Please break this into two categories as per the original request.
