S106 Money for Bridleway in Haywards Heath

The request was successful.

Dear West Sussex County Council,

The section 106 agreement in respect of the Bolnore Village development near Haywards Heath required Crest Nicholson (South) Ltd to pay approximately £50,000 to West Sussex County Council for the upkeep of lighting of a bridleway connecting Ashenground to Ashton House.

This Freedom of Information Act request concerns that money and its use to date.

Please:

1. State whether all or part of the money was paid by Crest Nicholson (South) and received by West Sussex County Council its agents or contracted third parties, specifying date(s), and amount(s).
2. If money was so received, state what if any of the money received has been spent, specifying date(s), amount(s), recipient(s) and briefly the purpose of the expenditure.

Yours faithfully,

Richard Carter

Dear Mr Carter

Freedom of Information Act 2000

I refer to your request for information in relation to S106 money for
bridleway in Haywards Heath.  Your request was received by me on 4 October
2013 and is being dealt with under the Freedom of Information Act 2000.

I am now in a position to respond to you as follows and regret the delay
in responding to you.

The bridleway lighting agreement in Bolnore Village is a S278/38 Agreement
and the sum received was £40,250 being the full cost of maintenance,
repair, renewal and replacement of street lighting.  The total sum was
paid to West Sussex County Council’s commuted sums account on 9 May 2012.

We have a difficulty in paying for these works because of contractual
problems which are still being worked through so we have not actually paid
this invoice yet, however the attached clearly shows the works and costs
as they stand at the moment.

I understand that the developer paid around £41,000, and this invoice will
have to be deducted from that sum.
