Overall I am interested in the issue of Planning Contributions, their numbers and financial value, as well as how these are monitored. Therefore it would be very helpful to include the number and value of Unilateral Undertakings and the number and value of s106 agreements.

your request below with supporting documentation attached.

 

This request concerns agreements made under Section 106 of the Town and
Country Planning Act 1990 (known as s106 agreements) particularly during
financial years 2014/2015 and 2015/2016 (to date) and compliance with
these s106 agreements.

 

1.      How many s106 agreements were made by EDDC in each of the years
stated above? 

 

2011/12 - 170 registered agreements

2012/13 - 196

2013/14 - 297

2014/15 - 307

 

Please note that these are registered agreements and some are likely to
have been withdrawn, refused, or be resubmissions or supplemental
agreements. Please see the attached spreadsheet for a breakdown of s106
agreements, where it’s been colour coded into financial years for ease of
reference.

 

2.      What financial contributions were due to EDDC arising from s106
agreements in each of the years stated above? - We do not hold this
information in a format which enables us to easily identify the financial
contributions that were due to EDDC arising from s106 agreements in each
financial year. To find this detail we would need to check through each
agreement during the stated time period. The attached list of each of the
applications where a s106 agreement was registered can be searched online
here

Simply enter the relevant application number into the search box and all
associated documents can then be accessed.

 

We estimate that to search through each of these agreements to locate the
ones specifically relevant to your request will take around 30 hours of
officer time. We know that it has taken an experienced officer some 6
hours to search through 200 of these documents and this is what we have
based our estimate on. This information is therefore exempt from
disclosure under s12 of the Freedom of Information Act 2000.

1. They should have offered the information for a fee if it exceeds the budget allowance.

2. Where a request is refused under S12 (cost), the Secretary of State for Constitutional Affairs’ Code of Practice paragraph II ((14) EDDC should have "consider(ed) providing an indication of what, if any, information could be provided within the cost ceiling" and "should also consider advising the applicant that by reforming or re-focussing their request, information may be able to be supplied for a lower, or no, fee."

EDDC is therefore in breach of the Code of Practice and an Internal Review request raised in response followed by a complaint to the ICO.

Interestingly, having voluntarily asked whether Unilateral Undertakings should be included to which the requestor said yes - I cannot find any mention of Unilateral Undertakings in the response.

I also wonder whether asking if you wanted these included was a ploy to increase the scope to the point that S12 could be used to deny the request.

I am writing to request an internal review of East Devon District Council's handling of my FOI request 's106 Agreement Monitoring and Compliance in East Devon'.

Having offered to supply information about “universal undertakings”, and I subsequently requested this, there was no mention of any universal undertakings in the response.

Did the offer to supply this additional information increase the scope of the question, such that it became exempt from disclosure under S12?  If not, please explain how this was not the case.  Why wasn’t some answer attempted, using the time allowed?

Does the reply that “We do not hold this information in a format which enables us to easily identify the financial contributions that were due to EDDC” affirm that EDDC actually has no system in place for aggregating the monies owed to the Council under s106 on a regular basis (monthly, quarterly, annually) as these accrue over the year? If there is a financial system why was the question not answered? 

The answers to questions 4 and 5 are inadequate and unacceptable

It is scarcely credible that a local authority holds no information whether there has been a breach of obligation and does not hold any information whether any action has been taken to recover payments not made and monies owed to the Council.

I am not satisfied with the answers to my questions and and I am not satisfied with the way EDDC have responded.  The reply has raised more concerning questions about how the council oversees and monitors its responsibilities in respect to s106 payments income.

I am sorry that you feel dissatisfied with our response to your request
for information. I have considered each of your numbered points and
respond as below:

 

Firstly though, I would point out that they are not ‘Universal
Undertakings’, rather they are unilateral undertakings. S106 agreements,
as they are commonly known, actually fall into types - bilateral
agreements or unilateral undertakings - although both arise out of S106 of
the Town and Country Planning Act 1990. It is confusing that both are
generically referred to as S106 agreements and the purpose of the request
for clarification was just to make sure you wanted both types, rather than
just the bilateral agreements. To be absolutely clear, and contrary to the
point made by Mr Freeman which you have picked up, there was no intent to
increase the scope. On the contrary, had you not wanted the information
from including the unilateral undertakings the time take would have been
less, although not necessarily sufficient to fall below the 18 hour
threshold. To be clear the answers given refer to generic S106 agreements
and therefore covers both types and so unilateral undertakings are covered
in the responses.

 

Question 2

Did the offer to supply this additional information increase the scope of
the question such that it became exempt from disclosure under s12? If not,
please explain how this was not the case. Why wasn’t some answer attempted
within the time allowed?

As set out above our request for clarification did not add to the time
taken to retrieve the information as all generic S106 agreements would
need to be checked in order to respond.

 

In considering your internal review, an officer has been through each of
the agreements pertaining to major applications which is likely to take
into account the majority of s106 contributions during the period. 10 and
a half hours of work has been put into retrieving the agreements from
these applications and this work is attached. The first page of the
spreadsheet lists every agreement during the time period that you
requested (rather than the longer periods covered in the original
response), together with its application number; whilst the second page
summarises the terms of the agreements for the major applications where
the agreements have been retrieved.

We have then sought to establish how much more of the requested detail
could be provided within reasonable time and cost limits.

For 2014/15 there are 307 relevant applications

For 2015/16 there are 144 relevant applications

In addition to the extraction of the major applications for both years, we
have also extracted the agreements pertaining to all of the 144
applications for 2015/16. These take the form of pdf documents and we will
send separate emails with a number of these attached to each - in order
not to exceed inbox limits. These emails will follow shortly.

For the applications for the previous year, each application reference can
be entered onto the planning section of our website and associated
documents can be viewed – including the agreement or undertaking.

As advised, some of the agreements may have been withdrawn, refused or be
resubmissions or supplemental agreements.

 

Does the reply that we do not hold this information in a format which
enables us to easily identify the financial contributions that were due to
EDDC affirm that EDDC actually has no system in place for aggregating the
monies owed to the council under s106 on a regular basis as these accrue
over the year?

At the time of your request, no aggregated total of outstanding monies is
held and the only way to retrieve this information is to search through
every agreement. For information, though not specifically relevant to your
request, we are introducing a new software system later in the year, which
will resolve this issue.

 

Question 4

It is scarcely credible that a local authority does not hold any
information whether there has been a breach of obligation and does not
hold any information whether action has been taken to recover payments not
made and monies owed to the council

We have taken action in respect of 118 breaches and potential breaches in
the past 2 years. Action taken is either undertaking a site visit, writing
to the developer or issuing an invoice.

 

Question 5

It is scarcely credible that a local authority does not hold any
information about how much it is owed for breach of obligations

The initial answer given is correct due to the open nature of the
question. However, and in order to be helpful, during the periods 14/15
and 15/16, 65 invoices have been issued for non payment of contributions
of which £730,967.10 remains outstanding.

 

I hope this review has been helpful in clarifying the position for you and
also that you will be appreciative of our efforts to provide as much
information as possible, within reasonable time and cost limits.
