S106 Agreement Funds in Worthing

Dear Worthing Borough Council,

Please could you provide me with details of all current S106 developer agreements for developments falling within Worthing Borough, along with any agreements outside the Borough where the agreement includes S106 money allocated to Worthing Borough.

By "current" I mean all agreements that have unspent developer contributions, as well as all agreements where the developer has not yet paid the agreed S106 amount in full.

For each agreement I would like to know:

* The title and location of the development.
* The full name of the developer.
* The date when the agreement was made.
* The total amount of S106 funding in the agreement.
* The specific infrastructure or council developments the S106 funding was allocated to, as specified in the developer agreement.
* The total of the S106 money paid by the developer to date.
* The circumstances (or dates) that will trigger payment of any outstanding S106 amounts by the developer.
* Details of what S106 money obtained from the agreement has been spent on, or is planned to be spent on, to date.

I have contacted our Planning Services Department who categorise S106
amounts as follows:

 

-          Amounts Available to spend – i.e. received but not spent

-          Potential Future Amounts – i.e. where agreement is signed but
not yet received

-          Amounts Committed Actual – i.e. amounts have been formally
allocated to a scheme

-          Amounts Committed Initially – i.e. amounts are earmarked for a
project but not yet formally allocated

-          Amounts Spent – Amounts are either sent to WSCC and spent by
them, or spent locally by the Council

 

Please can you clarify and tell me what it is that you are looking so I
can run a report for you.

 

Your request is now on hold until I hear from you.

 

If I do not hear from you in the next two weeks, the request will be
closed.

Dear Information Officer,

To clarify my request for S106 information for developments in Worthing:

For each agreement I would like to know:

* The title and location of the development.
* The full name of the developer.
* The date when the agreement was signed.
* The total amount of S106 funding in the agreement(if this is different to the sum of the various "Amounts" below).
* The specific infrastructure or council developments the S106 funding was allocated to, as specified in the developer agreement.
* "Amounts Available to spend" but not yet earmarked or allocated to anything.
* "Amounts Committed Initially" AND the names of the projects the money has been earmarked for.
* "Amounts Committed Actual" AND the names of the schemes that the amounts are committed to.
* "Potential Future Amounts" AND the circumstances (and/or dates) that will trigger these amounts by the developer.
* "Amounts spent": Details of what S106 money obtained from this agreement has already been spent on.

If it helps, I am particularly interested in the terms of the agreements, with respect to what the developers agreed to pay S106 money for in order to offset the impact of the development.

Dear Information.officer,

Thank you for that spreadsheet, which contains all the information I was looking for for the agreements included within it.

However the spreadsheet does not include any data for S106 agreements signed in the three-and-a-bit years since early July 2010.

Am I correct in assuming that this is because agreements that haven't yet resulted in payments being made aren't included in this spreadsheet?

If so, I would be happy to receive reduced details about S106 agreements that haven't yet made it onto the spreadsheet.

Specifically:

* The planning reference number.
* The date when the agreement was signed.
* The total amount of S106 funding in the agreement.
* The specific infrastructure or council developments the S106 funding was allocated to, as specified in the developer agreement.

The last two items are effectively the same information contained in the "Details of Monies" column in the spreadsheet.

Dear Mr Cartmell,

Firstly, I apologise in the delay in sending this through to you.

The first spreadsheet contains all those amounts that we have received. The reason that the most recent application on this is only from 2010 is because often there is a lag time between agreements being signed and the payment trigger being reached and this amounts being received.

Those agreements that have been signed but not received are the in second spreadsheet, the most recent of which is from February 2013.

The Councils Planning Officer is currently sorting through those agreements that have been signed from April 2013 and there are a couple more that need to be added to the spreadsheet, so this information is not currently on the spreadsheet.

If this information is also required please contact the Councils Planning Officer, Ms Hannah Groves on 01273 263421 in January 2014 when the information should be available or indeed if further information is required.
