Rough sleeping EEA nationals

Dear Liverpool City Council,

In May 2016 the Home Office issued new guidance on the administrative
removal of EEA nationals. This suggests that enforcement agencies can
administratively remove EEA nationals who are sleeping rough on the basis
that doing so amounts to a 'misuse of Treaty rights' (under the EU
Treaties). This request concerns the work that Liverpool City Council
has been conducting with Immigration Compliance and Enforcement (ICE) and
the Home Office in relation to rough sleepers.

Can you please answer the following questions:

1. From 2010 to present, how many visits have been made in Liverpool
specifically aimed at finding EEA nationals who are rough sleeping?

2. For each of these visits in Liverpool, please can you let me know:

a. the number of people questioned?

b. the date of the visit?

c. the location of the visit?

3. For each of these visits in Liverpool, was any information provided
to these people regarding:

a. the operation?

b. conditions for their rights of residence in the UK?

c. their possible removal from the UK as a result of their rough sleeping?

In each case, please provide copies of any information provided.

4. Do Liverpool City Council officers receive training on the right to
reside / procedural safeguards / proportionality? If so:

a. How often do Liverpool City Council officers receive such training?

b. Please provide copies of any training materials.

We look forward to hearing from you within 20 working days. If my request
is denied in whole or in part, I request that you justify all
refusals/deletions by reference to specific exemptions in the Freedom of
Information Act 2000.
