(1) When was the previously named role of PHSO Liaison lapsed please? (in post, assumed: Shane Derby): you may be able to publish historic (dated) information.

(2) You have said it now lies with others; therefore can you publish the role and job description of such 'others' to whom the responsibility falls? (Entirely; where PHSO liaison is concerned)

(3) Similarly: the training requirements? (In the case where PHSO liaison is concerned)

I would appreciate your not being too vague about this role i.e. PHSO communications and complaint liaison. NB: 'Final response' will be in the judgement of either FOI Questioner, or ICO.

My request as placed was in effect refused (deflected).

The NHS Trust has apparently decided to delay proper response for another 20 days by creating a new request out of it. I will comment on this in due course.

Your response appears to be unreasonably outside your duties in FOI. You said "Your request was received on 25/03/2020 and I have logged it as a new request" . Please advise me of the new FOI case you have created so that it can be properly recorded as a new request.

I note therefore that help in response as requested and as I am entitled to expect under FOI terms, was refused.

I am seeking an internal review of that response and will record this as the status under this request number; my request for internal review begins from this date 27/03/20 instant, thank you. You may wish to explain why you consider this a new request so much different from your previous response in advising me that PHSO Liaison has been re-termed, with identical or similar duty/duties to cover.

UPDATE: Delays in response and Coronavirus situation;

I appreciate that there are pressing and important matters concerning safety of existing patients of the Trust during coronavirus situation. Please refer upwards if you feel that this request is outside your understanding and capability.

However, my lay understanding in FOI and in inability of the Trust to update me with words indicating progress and status of request(s) as placed does not to me appear to excuse taking so long to request clarification at each step and/or claim that each step resets the clock on the original request.

Nota Bene: With matters ongoing I will point out that under Trust NHS contract terms it will be malpractice if not illegal to employ treatments, measures or tactics that shall harm persons without their personal or delegated consent. I sincerely hope that it is not with Trust intent to play on persons' stresses; traumas; disabilities; or to avoid or delay response; to use tactic; or be disingenuous; against Equality Act 2010.

Please continue review this request in line with FOI procedures and delayed response to my request and clarifications as requested and provide me with a target date and contingency plans for reasonable compliance. Please update this complaint at

(annex 1 - The Trust is fully aware of my disabilities in this state avoidably extended for a number of years. The Trust has demonstrated failure in duties to enquire or act under The Act to make allowance and to which NHS parties are not exempt.)

For the record - a review was requested and I did not indicate thus on this FOI platform.

Response due 27/03/20 + 20 days, as stated above.

(BSMHFT has procrastinated on this response and it is to be reviewed. It was claimed a 'final' response answered the question but did not comply with FOI duties to help (or elaborate) to assist the questioner in regard to the previously titled PHSO Liaison office as sole or joint responsibility. I am able to give quick note at this time due to the ongoing pressure and stress BSMHFT negligence in my son's death has left me with, aggravated by BSMHFT/PHSO collusion and 11 years of lack of professional candour, lying and denial of injuries provoked (as will be evidenced soon).

I asked for Job description of PHSO Liaison officer now or when that was the role. You said "The previous Customer Relations Lead (where the role of the PHSO Liaison officer is held) was in post up to 25/09/2018"

(1) Have I missed something please? You did not attach Role-description of that previous office as requested in second response. I have incriminating information releases to PHSO from that office hence my question.

(2) Additional matter attached is part relevant to my question and part revealing of BSMHFT attitudes to complaints and patients - your single first consideration.

(3) I note you would not provide the role detail, against which you judge later recruits for your complaints handling team.

(4) I am aware of sign-off responsibilities, but BSMHFT current Chief Exec. refused to discuss inherited maladministration, exactly as previous CE declined. I think I saw something about candour and excellence in your other attached roles.

Your mention of delay under the new COVID-19 emergency cannot be accepted as excuse. Neither can I be discriminated against in slow response. You may not recall that delay in Care process was critically the reason for my son's death and why ignored complaints - all made before my son died - are UNRESOLVED 10 years later.

When I able to, I will almost certainly refer to ICO office for their opinion.
