Thank you for your email of 18/05/2018 where you requested information
about Roads compensation 1990-2015 inclusive
In order to provide you with the information on the scale that you have
requested would require us to individually interrogate each claim logged
from 1990-2015 to calculate payments for compensation alone, as our system
does not allow us to run a report with a breakdown of the financial
information.
Section 12 of the Act makes provision for public authorities to refuse
requests for information where the cost of dealing with them would exceed
the appropriate limit, which for Local Government is set at £450. This
represents the estimated cost of one person spending 18 hours at £25 per
hour in determining whether the Council holds the information i.e. in
locating, retrieving and extracting the information.
We estimate that it will take us in excess of 18 hours to determine the
appropriate material and locate, retrieve and extract the information in
reference to your request. Therefore, your request will not be processed
further.
You may wish to refine your request by narrowing its scope by being more
specific about what information your particularly wish to consider,
including any dates or period of time relevant to the information

which the requester can choose from with a timeframe]
If you are dissatisfied with the handling of your request, you have the

Thanks for your response. Please find our revised request below.
Please dispand with all numbered instructions and instead provide the total compensation paid (for damage caused to property or person) due to poor condition of roads (potholes, etc) for the years you are able to do so starting with 2015 and work backwards until either the data is no longer reasonably accessible or until you reach the beginning of 1990 (whichever happens sooner).
It is our preference for these figures to include any additional costs (such as legal fees). If this is not possible then please kindly provide the data anyway and state what is included.
In terms of which year to put the compensation figures we shall provide an example. If the damage occurred in the year 1998 we would prefer the amount paid to appear in the 1998 column and so on. If you cannot arrange the data in this way then please kindly base it on the year the claim was made. For instance if the claim was made in the year 1999 then kindly arrange for the amount paid to appear in 1999. If however you are again unable to arrange the data in this way then kindly provide it in any available way stating how it is arranged.

I write with reference to your request for information under the Freedom
of Information Act which was submitted by email on 18 May and subsequently
revised on 29 May.
The information we are able to provide is in response to the following
amended requests:
1. Total claims for compensation your Council received due to poor
condition of roads (potholes, etc) for the financial years 2001/02 –
2015/16.
2. Total claims your council paid out in compensation due to poor
condition of roads (potholes, etc) for the financial years 2001/02 –
2015/16.
3. Total compensation paid out due to poor condition of roads (potholes,
etc) for the financial years 2001/02 – 2015/16.
I attach a spreadsheet providing the information requested. Please note
that the compensation figures also include any legal fees paid in relation
to the claims
For the financial years 2001/02 to 2008/09 the information provided does
not include compensation claims or payments arising from vehicle damage
claims only (ie claims not involving any personal injury element). For
the financial years 2009/10 onwards the information does include these
types of claims.
