Thank you for your email of 08/03/2020 where you requested some
information relating to road traffic collisions, locations and equipment
found on fire appliances. Your full request followed by our response is
provided below.

For question 4, 5 and 6 (registration mark) South Yorkshire Fire and
Rescue (SYFR) are unable to provide the information requested and are
exempting this under Section 31 Law Enforcement and Section 38 Health and
Safety of the Freedom of Information Act (FOIA).

 

Under Section 17 of the FOIA we are required, when refusing to provide
such information (because the information is exempt), to provide you with
a notice which: (a) states that fact, (b) specifies the exemption in
question, and (c) states, if that would not otherwise be apparent, why the
exemption applies.

 

I wish to advise you that within this request the following exemptions
apply:

 

Section 31(3) - Law Enforcement and Section 38(1) Health and Safety

 

As we are applying these exemptions to your request I am providing below
the reasoning of why this information is being withheld.

 

Section 31(3) – Law Enforcement and Section 38 Health & Safety

 

The two sections have been grouped together due to the close links and
overlap of reasoning in not disclosing the information.

 

Both the law enforcement and health and safety exemption is based on the
effect that disclosure of the information would have, and not on the
information itself or source of the information. 

 

As you may be aware, disclosure under the FOIA is a release of information
not only to you but the public at large.  Whilst we are not questioning
your motives, releasing any information held regarding the location, list
of equipment and vehicle registration numbers which we use within the
Emergency Service could enable those engaged in criminal activity to
formulate a local and national picture to identify any vulnerabilities
that could be exploited.  Section 31(1)(a) The prevention or detection of
crime, states that any information that would make anyone including the
public authority more vulnerable to crime is not to be disclosed and we
believe that by releasing this information to the public could potentially
encourage criminal activity and put public safety and our staff at risk.

Releasing this information, could lead to an increase in harm of attacks
on our vehicles, endanger our staff and partner agencies and compromise
law enforcement.  Information that could be used to undermine our
operational integrity would be to the detriment of providing an efficient
emergency response service and a failure in providing a duty of care to
protect the safety and wellbeing of all members of SYFR staff and the
communities we serve and have a negative impact on law enforcement.

 

Fire and Rescue Services are part of the Critical National Infrastructure
and therefore we have a duty to protect our assets and people and provide
appropriate security to ensure resilience and be able to deploy our
resources accordingly.

 

It has been recorded that the FOIA releases are monitored by criminals and
terrorists and so releasing information held regarding the equipment
located in one of our emergency vehicles would undermine and compromise
law enforcement and it would also hinder any local, regional or national
operations or making any emergency response vehicle a target and at a
greater risk.  This may lead to the emergency services needing to increase
their resources to reassure and protect the community.

 

The ICO guidance additionally affirms that disclosure of information
should be withheld if it would or would be likely to endanger the safety
of any individual.  Further information on this section is available on

When applying these exemptions, we must consider whether the public
interest favours disclosing or withholding the information.

 

There is strong public interest in transparency, allowing the public to
know how public funds are spent and by providing information of the
equipment on our emergency vehicles would allow the public to gauge the
appropriate use of these funds in carrying out their local safety
obligations.  It would additionally enable the public to have a better
understanding of the effectiveness of the emergency services and provide
reassurance regarding the level of capability in South Yorkshire and our
ability in preventing potential danger to the public. 

 

The strongest reason favouring non- disclosure is the need to ensure that
public safety and the safety of our staff are not placed at risk by what
is mentioned in this response. 

 

On balance, I find there is a much stronger public interest in withholding
this information.

 

In accordance with the Act, this response represents a Refusal Notice for
your request.

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
