Dear Norfolk Fire and Rescue Service,

I am requesting a FOIA on any and all reports, records, statements, photos, and witnesses for a motor vehicle accident where the Norfolk Fire Dept., was on the scene on DOL: 1/30/2020 at 2100 Colley Ave, Norfolk, VA, involving a 2010 Ford Escape and a 2007 Jeep Commander.

I refer to your request for information dated 14 December 2020.

 

You asked for:

 

I am requesting a FOIA on any and all reports, records, statements,
photos, and witnesses for a motor vehicle accident where the Norfolk Fire

Your request has been considered and is refused.  In accordance with the
Freedom of Information Act 2000 (the Act), this letter acts as a Refusal
Notice.

 

Exemption

 

Section 21(1) of the Act provides an exemption for release of information
that is reasonably accessible to you even if it is accessible only on
payment of a fee.

 

Information is to be taken to be reasonable accessible if it is
information which the County Council or any other person is obliged by or
under any statute to communicate to members of the public on request
whether free of charge or on payment.

 

Reason

 

This decision is based upon the following reasons

A copy of the report can be requested via [1][email address]. This
is a chargeable service. Details on the costs to process this request can

We are therefore unable to release this to you under FOI as the report is
available, as set out within the publication scheme, for a fee.

The power to charge a fee for provisions of the Fire Report is facilitated
under section 18A(1) of the Fire and Rescue Services Act 2004 (FRSA)
[inserted by the Localism Act 2012], which states that, “A fire and rescue
 authority may charge a person for any action taken by the authority…
 subject to the provisions of this section and section 18B.” 

If you are dissatisfied with our handling of your request you have the
right of appeal through the Council’s internal review procedure by setting
