Request for Information

I refer again to your e-mail of 15 July 2009 seeking information relative
to road inspections for Crammond Avenue, Coatbridge.

Having investigated, my response to your various queries is as follows:-

(1) I can advise that Crammond Avenue is classed as a
local access road. The inspection frequency is once a year and is carried out
from a vehicle containing two persons.

(2), (3) & (4) I attach inspection, maintenance and complaint records
for Crammond Avenue for the period 1 August 2007 to 1 August 2008, adjusted to
exclude anything not relating to your request and anything which constitutes
personal data in respect of which disclosure would contravene the Data
Protection principles and that this constitutes a ground of absolute exemption
in terms of Section 38 of the Freedom of Information (Scotland) Act 2002. The
details edited from the documents which are effectively being released into the
public domain for all to access - are names of individuals. With regard to your
queries numbered (2)(c), (3)(c) and (4)(e) I can advise that dimensions of
defects are not routinely recorded and in terms of Section 17 of the Freedom of
Information (Scotland) Act 2002, I must advise you that the information sought
is not held.

(5) There are no records of accidents involving
persons or vehicles on Crammond Avenue for the period 1 August 2007 to
1 August 2008.

(6) The minimum depth of which a pothole would be
recorded for repair is approximately 40 mm.

I can advise that North Lanarkshire Council, having regard to the
provisions of Section 21 of the Freedom of Information (Scotland) Act
2002, has established a procedure whereby any person who has requested
information and is in any way dissatisfied with the decision on that
request, can require a review of that decision by writing to the Executive
Director of Corporate Services, Civic Centre, Windmillhill Street,
Motherwell ML1 1AB. Accordingly, if you are dissatisfied with this
decision and seek such review please write to the Executive Director of
Corporate Services.

I would advise, also, that in terms of Section 47 of the Act a person who
is dissatisfied with a notice given by the local authority under Section
21 of the Act - ie. a notice following a review of a decision by a local
authority, or by the failure of a local authority to give such a notice -
may make application to the Scottish Information Commissioner for a
decision as to whether, in any respect specified in that application, the
request for information to which the requirement relates has been dealt
with in accordance with the Act. Such an application must be in writing
or in another form which, by reason of it having some permanency is
capable of being used for subsequent reference - for example a recording
made in audio or video tape - must state the name of the applicant and an
address for correspondence and must specify the request for information to
which the requirement for review relates, the matter which gave rise to
the applicant's dissatisfaction with the original decision of the local
authority and the matter which gives rise to the applicant's
dissatisfaction with the decision on review by the local authority or the
failure of the local authority to issue such a decision. The Scottish

thank you for the information detailed.

Question 3 has not been answered. Date of last inspection before 02/02/08. (presumably around 20/05/07?)

Question 4 regarding complaints has not been answered. If on the attachment, then the details have been removed or are unclear. I do not require persons names, merely number of complaints received, the dates received, the subject of the complaint, the locus and whether repairs were required as a result. As you have stated that the inspection is annual then the relevant dates for enquiry are now between 20/05/07 (or whenever the annual inspection was carried out that year) and 20/5/08.

New Question. What prompted the enquiry on 20/2/08? If it was a complaint, what date was it received?

Dear Sir / Madam

I refer to your email of 18 August in response to mine of 11 August 2009,
and can advise that the date of the last inspection prior to 2 February
2008 was 23 May 2007. The record of this inspection was supplied in my
email to you of 11 August.

With regard to the enquiry record of 26 February 2008, this was entered
onto the system by a road inspector. This enquiry may well have been
generated following a complaint, however, this has not been recorded and
there is no further information held regarding this enquiry record. I can
also advise that there are no other recorded complaints regarding Crammond
Avenue having been received in the period from 1 August 2007 to 1 August
2008.
