·         During a recent restructure of the service our street sweeping
schedule has been addressed to fit around the service. Various inner town
wards are to be swept and maintained fortnightly, and wards on the
outskirts of the borough are to be done every four weeks.

·         However Walk Lane has been highlighted along with a few other
locations that require a fortnightly sweep, so this will be the case for
this request.

·         As part of the EPA Act, we are obliged to clear mud and debris
from the highway, within 24hrs of it being reported.

·         Should this become a persistent offence, the complaint would be
reported to our Highway Enforcement team for further investigation.

Additionally, I would be most grateful if the Council could provide me

·         We do not have a separate procedure in the event that a road is
not cleaned, either due to vehicle breakdown or blocked access, however we
would attempt to undertake the works on the nearest date a vehicle was
available or access granted.

Please find attached our cabinet report where discussions were ratified to
amend the street cleansing structure,  section 1.4, which includes the new
sweeping rounds. We have previously sent you a detailed map of the
locations that require 2 weekly and four weekly sweeping schedules.

 

As previously mentioned Walk Lane is on a fortnightly sweeping schedule
due to the proximity of the access routes from the farmers’ fields onto
the highway.

 

If the drivers attends and the road is clean, it will not be swept but
inspected and recorded as so.

 

Should an incident be reported via the NELC “REPORT IT” option on web
site, between these occasions, we shall attempt to attend within 24hrs of
the complaint to clear the highway. Should persistent fouling of the
highway occur this shall then be passed to our Highways Enforcement team
to follow up.

 

If you believe that your request for information has not been handled in

Thank you for your response.

The Council state:

I understand a schedule is a plan for carrying out a process or procedure, giving lists of intended events and times. An example of a local authority sweeping schedule can be found on the link below.

The Council have not issued a refusal notice relating to the information requested concerning the schedule. Consequently, I would be most grateful if this information is now provided to me within 2 working days.

The Council also state:

Further to your request an Internal Review has taken place into North East
Lincolnshire Council's handling of your information
request NELC/6922/1718, concerning Walk Lane.

I have reviewed the response provided to you and the handling of your
request in accordance with the Freedom of Information Act and find:

o That your request was responded to within the statutory time of 20
working days;
o That you were informed whether or not the information you asked for
was held by North East Lincolnshire Council;
o That you were provided with the information you asked for available
under the Freedom of Information Act; and
o That your response provided you with your rights of appeal. 

I am therefore satisfied that the Council has acted in accordance with the
Freedom of Information Act in the handling of your request.

In a subsequent email you asked for the following:

1)    The Council have not issued a refusal notice relating to the
information requested concerning the schedule. I would be most grateful if
this information is now provided to me within 2 working days.

 

2)    I would be most grateful if the Council could provide me with a
complete copy of the relevant policy and procedure relating to this
matter, and in particular, how their drivers 'inspect' and therefore

information is now provided to me within 2 working days.

 

4)    Please also include complete copies of all information relating to
the training of and details of any qualified standards the drivers have
received in this specific area of assessment, determination and recording
of the cleanliness of a public highway.

 

I will address each of these points in turn:

 

1)    A refusal notice was not issued as the information held by North
East Lincolnshire Council was provided to you in the response. To clarify
the information provided to you constitutes the recorded information held
by NELC in relation to a road sweeping schedule.

 

2)    There is no further recorded information held by NELC. The drivers
do not have any specific training for these inspections as it is  a visual
inspection on the day of the visit. The driver shall still turn up to
undertake a sweep of the highway, but if no detritus, litter or mud are on
the highway he will not undertake a sweep. We are attempting to ensure
only areas that require a sweep are maintained, and not sweep clean roads.
The Code of Practice on Litter and Refuse and the Environmental Protection
Act 1990 is followed by operatives and no further recorded information is
held.

 

3)    To clarify, there is no further information held by NELC other than
that already provided.

 

4)    North East Lincolnshire Council holds no further information in
relation to training regarding this specific issue.

Although you may be of the view that further information is held by North
East Lincolnshire Council, I can confirm that upon review the request was
answered appropriately and provided you with all relevant information to
the request.

I trust that this Internal Review answers your queries in relation to your
request, and clarifies that your request has been handled in accordance
with the Freedom of Information Act.

The Council further states:

Bearing in mind that the Council provided me with a copy of their road cleaning schedule for Walk Lane several years ago, I am little bemused by this response since it is seems improbable that their drivers know when and where to clean public highways in the borough in the absence of a road sweeping schedule.

I believe any reasonable person would agree that any road cleaning schedule would consist of recorded information pertaining to the dates of the next routine scheduled cleaning visits for a specified public highway.

Furthermore, I also provided a link to another local authority's road cleaning schedule as example to clarify exactly what I was requesting from the Council in this regard.

However, in consideration of the substantial multitude of public highways within the borough please clarify whether road cleaning is now on an 'adhoc basis' where at their discretion and in the absence of a road sweeping schedule, drivers unilaterally decide when and where to clean public highways within North East Lincolnshire when they arrive for work each day.

However, in consideration of the substantial multitude of public highways
within the borough please clarify whether road cleaning is now on an
'adhoc basis' where at their discretion and in the absence of a road
sweeping schedule, drivers unilaterally decide when and where to clean
public highways within North East Lincolnshire when they arrive for work
each day.

 

Cleansing is not on an Adhoc basis, drivers attending a street/road are
fully competent to recognise an area that requires sweeping or is still
clean. If a specific road is clean operatives will not clean the area as
this would wear down brushes with no benefit. All our drivers are very
conscientious and undertake their sweeping rounds in a professional
manner. Should a member of the public feel they are not undertaking their
duties correctly we have a reporting system for complaints that would be
actioned immediately.

 

Please also clarify that if there is no road cleaning schedule, how
drivers report their completion of their daily cleaning tasks, findings
and quality assurance of cleanliness of the public highways cleaned.

 

The whole of the borough is on a sweeping round. Should a driver visit a
road/ street, he would input the following on his round sheet, Not swept
(inspected) Swept (Drivers signature) and dated.

 

Please also clarify as to exactly how the information provided by the
Council concerning the road sweeping schedule 'fits around their service'.

 

The sweeping rounds we have fits around the service and ensures that all
roads are visited at least every four weeks in some outlying wards, 2
weekly in inner borough wards along with some highlighted areas of the
rural that are prone to heavy use of farm traffic.
