iv) Please confirm if an IR35 assessment has been completed upon Mr Hare. Is he treated for taxation purposes as an employee or as an 'interim' or 'self-employed' person?

Dear Kent County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Risthardh Hare - Social Worker'.

It is clear to me that Mr Hare's salary should be public.

This is in line with Section 12 of the Code of Recommend Practice for Local Authorities on Data Transparency, which Kent County Council note they follow in respect of staff earning over £50,000 which Risthardh Hare surely does.

Dear Mr Parkins

Further to your complaint dated 12 February 2019, I have been tasked with
carrying out an independent review of the Council's response to your
request for information; this is in accordance with your rights under the
Freedom of Information Act 2000 (FOIA). 

There is no statutory timescale for carrying out reviews but to comply
with guidance we do endeavour to complete them within 20 working days
wherever possible. I would like to offer my sincere apologies for the
delay in responding to you, which has been caused by unprecedented
resource issues within the last few weeks that has impacted on our service
delivery and we are sorry for any inconvenience this delay may have
caused.

On 10 January 2019 you asked us to supply you with answers to four
questions concerning the Mr Hare who you believed to be employed by Kent
County Council in the role of Assistant Director Safeguarding. 

We provided a response to your request on 6 February 2019 (within time
scales).

In your request for a review you disagreed with our decision that
information relating to Mr Hare's salary was exempt from our disclosure
obligations and advised that Mr Hare's salary should be public. You added
that this should be in line with Section 12 of the Code of Recommend
Practice for Local Authorities on Data Transparency, and therefore you
believe we are not acting in accordance with either national statutory
guidance / regulation or the Council's policy in withholding Mr Hare's
salary and his 'hourly rate' should be supplied.

As the focus of your concern is the disclosure of Mr Hare's salary and
hourly rate, my review has considered whether our non-disclosure under
section 40(2) of the FOIA was appropriate.

As you will be aware from our earlier response Mr Hare is not directly
employed by KCC, his services have been procured by the Council via
Connect2Kent and as such he is not a KCC employee. This is why details of
his remuneration are not disclosed on the Council's website.

Connect2Kent is the recruitment managed service provider for Kent County
Council, it is part of Commercial Services which is a company wholly owned
by Kent County Council and a public authority in its own right for the
purposes of compliance with the FOIA.

However, KCC has already acknowledged we do hold some information falling
under the scope of your request and following discussion with
Connect2Kent's Data Protection Officer, it is clear that the information
relating to Mr Hare's salary and hourly rate are considered to be 3^rd
party personal information. Disclosure of this information into the public
domain is neither lawful or fair and I therefore find disclosure falls
outside of our obligations by virtue of section 40(2) of the FOIA.

To conclude, I find that our original decision is maintained and we are
unable to uphold your complaint.

If you are not content with the outcome of this Internal Review you have
the right to apply directly to the Information Commissioner's Office for a
