Dear Perth and Kinross Council, I travel regularly on the A90 and A9 and am aggrieved by the amount of litter on the verges and central reservation and by the lack of cleanliness at many junctions. Section 89 of the Environmental Protection Act 1990 is relevant. I note that the presence of plastic bottles containing liquids of various colours is not uncommon.

My request is to receive from you, a copy of the risk assessment procedures used by Perth & Kinross Council in identifying the nature of the liquid contents of such containers.

In addition, I request a copy of the processes and authorisations utilised for the subsequent collection, transportation, storage and disposal of the liquid wastes.

storage and disposal of the liquid wastes.

I consider that the substance of your request is covered by the definition
of environmental information contained in the EIRs and that your request
as a whole should be dealt with under the EIRs. I am currently dealing
with your request under the EIRs and will issue my response by 16 January
2018 which is 20 working days as permitted in terms of regulation 5(2)(a)
of the above legislation.

Request:

by Perth & Kinross Council in identifying the nature of the  liquid
contents of such containers.

 

2)            Please also provide a copy of the processes and
authorisations  utilised for the subsequent collection,  transportation,
storage and disposal of the liquid wastes.

 

Response

 

In relation to the above, I am advised of the following;

 

1.    There is not an individual Risk Assessment for liquids in sealed
containers; our staff would simply dispose of these items within the
general waste stream. The only exception would be if the containers were
marked as being hazardous waste and had been fly tipped. This would
require Perth and Kinross Council to report this to the Scottish
Environment Protection Agency (SEPA) and dispose of the materials using a
specialist contractor.  In terms of section 17(1)(b) of the Freedom of
Information (Scotland) Act 2002, this is formal notice that this
information is not held by Perth and Kinross Council

 

2.    Any sealed containers found to still contain liquid material would
remain within the general waste stream and disposed of accordingly. If
bodily fluids are identified then the following is in the Safe Systems Of
Work for safe removal and disposal:

 

Uplift / Cleaning of Body Fluids

 

The following procedure is to be complied with when uplifting or cleaning
excrement, blood or any other body fluids.

•  Only uplift or carry out cleaning when it is safe.  Cone the area off
and use hazard lights if necessary.

•  Always use the designated PPE, e.g. disposable gloves, face mask,
protective glasses or full-face visor and when required disposable
overalls.

•  When uplifting any fluids, especially blood, examine the area carefully
for contaminated sharps, needles, etc.   If any are found do not touch
them – mark their location and then fetch or call for a sharps recovery
kit to be brought to the area then carry out the sharps recovery
procedure.

•  After cleaning the area use disinfectant to sterilise it then use
absorbent granules/towels, etc, to dry the area and remove the danger of
slips and falls to members of staff or the public, particularly in
stairwells, lino floors, etc.

•  If necessary you can use absorbent granules/towels, etc, for heavy
deposits of liquid waste.  Granules/towels, etc, can be double bagged and
disposed of in the normal waste stream.

•  When using a pressure washer you must cone off and screen the area from
the public before starting any cleaning operations.   You must ensure that
the safety area is large enough to prevent spray drift onto any
passers-by.

•  Only trained and authorised persons may use a pressure washer.

•  Always try to use some form of implement when handling waste i.e. brush
and shovel, litter picker, etc, and always wash and disinfect the
implement immediately afterwards.

•  Clean your hands immediately after uplifting any waste or cleaning an
area contaminated with blood or other body fluids by using your hand
wipes.

Dear Perth and Kinross Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Perth and Kinross Council's handling of my FOI request 'Risk assessment for removal of containers of liquid'.

I originally asked for information about the risk assessment procedures used in identifying the nature of the liquid contents and subsequent disposal etc of containers found littered at the roadside. I was told that you do not have such procedures,
However, in response to a supplementary question about the disposal of them, your answer refers to -
where body fluids are identified.
Those two response appear to be in conflict.
Is it the case therefore that you do not have appropriate risk assessment procedures and as a consequence do not remove containers of liquid ? This might explain why there are so many of these containers at the roadside within Perth & Kinross or are containers being removed without appropriate Health & Safety and Waste Management considerations being applied?
