Further to my email below, on further discussion with the Trust's Head of Estates, the Trust has concluded that it requires further clarification from yourself to enable the appropriate response to be provided to you.

I would be very grateful if you could provide clarification as to what type of risk assessment your request is referring to. Is your request concerned with:

• Risk assessments conducted by external contractors, and/or
• Risk assessments undertaken to meet certain requirements (for example in terms of Legionella the risk assessments set out by the Health and Safety Executive's Approved Code of Practice L8), and/or
• The Trust's own internal corporate risk assessments.

In addition the Trust would be grateful if you could provide some further clarification regarding your question concerning a risk assessment for 'Electrical'. Could you provide some more detail as to what type of electrical risk assessments you would be referring to? If you could provide examples or further detail, this will ensure that the Trust has sufficient information to interpret your request correctly and therefore provide you with the specific response you require.

Further to your request for information concerning risk assessments.  The
Trust has answered your questions in the order they appear in your
request.

 

 

1.     Legionnaires Disease

 

The Trust’s Legionella control policy and maintenance measures reflect HSE
Approved code of practice and guidance (L8).  Risk assessments are
completed for each area of the Trust in line with L8 requirements and must
be undertaken every two years.  These risk assessments are held in paper
format and equate to approximately two metres of documentation (approx 20
lever arch files). 

 

The Trust considers that in this instance it is not possible to provide
photocopies of these risk assessments, as it is not practical or
appropriate to remove the folders for photocopying.  The Trust’s
obligations in line with L8, require that the folders are available
immediately in the event of a suspected Legionella outbreak.  The Trust
does not feel it is appropriate for the folders to leave their storage
area, even for a limited amount of time due to the critical importance of
their accessibility to ensure that the Trust meets its requirements; and
as such in this instance the Trust does not consider that it is feasible
to provide access via photocopies.

 

The Trust considers that it is however possible to provide access by
allowing you to attend the hospital to view the records.  If you would
like to view these files, the Trust can arrange an appointment for you to
visit the hospital.  Please let me know if this is a suitable arrangement
for you.

 

 

2.     Glazing

The Trust has an externally completed Glass /Glazing Risk Assessment
Survey which was undertaken in 1999.  This survey is in a paper format. 
Could you please advise me of the postal address this should be sent to. 
If however you would like the document in an electronic format, please let
me know and I can arrange for the document to be scanned and sent to you
by email.

 

 

3.     Lightning (Clarification Received: as per BS?EN62305/2006)

The Trust can confirm that it does not hold a risk assessment for British
Standard EN62305-2:2006 in relation to lightning.  The Trust is not
required to have such a risk assessment in place as the geographical
location of Exeter is deemed to be a low risk, rated at 5 thunderstorms
per year or fewer on British Standard EN62305-2:2006. 

 

 

4.     Gasses

The Trust has requested clarification from yourself regarding this
question, as to the type of ‘gasses’ you are referring to.  Once the Trust
receives this clarification it will be possible to continue processing
this question.

 

 

5.     Electrical (Clarification Received: When I ref to "Electrical" I
refer to a Risk Assessment for your electrical safety RA including
eui-potential ground,earthing etc)

The Trust can confirm that it does not hold any risk assessments in
relation to your question

Further to your request for information concerning the Trust’s fire
protection risk assessments; please see the Trust’s response below.
 
 
The Trust can confirm that it has approximately 150 fire protection risk
assessments in place, as risk assessments are required for individual
areas within the Trust.  The Trust has carefully considered your request
for copies of these fire protection risk assessments, but has, however,
declined under exemption 38 of the Freedom of Information Act.
 
 
Section 38 of the Freedom of Information Act states that:
 
(1)   Information is exempt information if its disclosure under this Act
would, or would be likely to –
 
(a)   Endanger the physical or mental health of any individual, or
(b)   Endanger the safety of any individual
 
 
 
The Trust believes that information which concerns the Trust’s safety
measures should be considered for exemption, under section 38.  The
information you have requested concerns the Trust’s fire protection
measures, and as such relates directly to the safety of the Trust, its
patients, staff and visitors.  ICO guidance suggests that instances where
section 38 could be applied may include requests for information which
could lead to locations being open to sabotage.  The Trust believes that
providing details of the Trust’s fire protection risk assessments would
place into the public domain details that could increase the potential
vulnerability of the Trust’s property to threats and as such potentially
endanger the physical health and safety of any individual on the Trust’s
property.
 
Therefore, due to the sensitive nature of this information and the impact
that the release of such details into the public domain would have in
terms of potentially compromising safety, the Trust deems that the
information should be withheld. 
 
 
The Public Interest Test:
The Trust is required to undertake the Public Interest Test, to weigh the
harm that is identified against the wider public interest that may be
served by disclosure; please see the details below.
 
The Trust recognises that the release of such information would facilitate
and promote Trust transparency and would enable the public to have an
increased understanding of the Trust by bringing into the public domain
information affecting public health and safety, and as a consequence the
public would have an understanding of the safety mechanisms in place (and
is therefore of benefit to the community).  This in turn would generate
confidence in the Trust’s safety measures to protect it patients, staff
and visitors.
 
The Trust however considers that releasing the information requested would
have the potential to jeopardise the safety of anyone within the Trust’s
buildings, as the information provides details relating to the fire
protection mechanisms in place.  If this information were to be placed in
the public domain, details would therefore be available that could make
the Trust vulnerable to external threats.  This in turn has the potential
to endanger the safety of patients, staff and visitors.
 
Therefore in conclusion, the Trust can confirm that its has considered the
arguments for both release and exemption, and has reached the decision
that in this instance the potential risk posed to patients, staff and
visitors by the release of the information requested is greater than the
public interest and benefit that would be served by releasing the
information (as a result of the potential consequences that the release of
the information may have), and as such the information is being withheld
under section 38 of the Freedom of Information Act.
