Thank you for your information request of 22 April 2019.  Aberdeen City
Council (ACC) has completed the necessary search for the information
requested. Our response is now detailed below.

 

Please could you confirm and supply any details of the suggestion that the
area of land which the Former Cordyce School site, Dyce was located on was
bequeathed to the Council for use as only Care or Education purposes only.

Following an inspection of the Council’s title it can be confirmed that
the land was not bequeathed to the Council. It was conveyed by the way of
two dispositions to the Council for a financial consideration. Neither
disposition restricts the use of the land to care or education purposes.

 

Who this was gifted by and if this has any possible legal restrictions on
the future use of the land

The land was not gifted to the Council.

 

INFORMATION ABOUT THE HANDLING OF YOUR REQUEST

 

As the information which you requested is environmental information, as
defined under Regulation 2(1) of the Environmental Information (Scotland)
Regulations 2004 (the EIRs), ACC considered that it was exempt from
release through FOISA, and must therefore give you notice that we are
refusing  your request under Section 39(2) of FOISA (Freedom of
Information (Scotland) Act 2002).  However, you have a separate right to
access the information which you have requested under Regulation 5 of the
