Please find below the response to your recent request for information under the
Freedom of Information Act 2000 (FOI), which was received on 26 June 2023.
This response has been provided by NHS Humber and North Yorkshire Integrated
Care Board (ICB) which was established on 1 July 2022. The ICB operates from six
geographical Places/Health and Care Partnerships and this response relates to:
East Riding of Yorkshire (ERY), Hull, North East Lincolnshire (NEL), North
Lincolnshire (NL), North Yorkshire (NY) and York Health and Care Partnerships
(HCPs).
Information Requested
If you are registered with a GP surgery in England and you are referred by a GP to a
consultant or specialist in mental health, you have the legal right to choose the
organisation (qualified provider) to whom you are referred, as long as that
organisation is providing that service in another part of England.
Can you tell me under the NHS right to choose agenda how many individuals since
2021 have chosen to receive an assessment and or treatment for ADHD from a
provider other than your commissioned provider, could you also tell me the total
value spent on these ADHD private providers since 2021.
Response
NHS Humber and North Yorkshire Integrated Care Board can confirm that in respect
of ERY, Hull, NEL and York HCPs, it does not hold the requested information as
information in the required detail is not recorded.
For North Lincolnshire HCP, the ICB can confirm that it holds the following
information which comprises assessments and treatments for both Autism spectrum
disorder (ASD) and Attention deficit hyperactivity disorder (ADHD) for independent
providers of non-commissioned services.

* The ICB can confirm that the information requested is held, however, the ICB
considers this information is exempt under section 40 (personal information) of the
Freedom of Information Act 2000 (FOIA), as the information constitutes third party
data. Section 40(2) provides that personal data about third parties is exempt if one of
the conditions set out in section 40(3) is satisfied. Under the FOIA, disclosure of this
information would breach Data Protection Principles contained within Data Protection
Legislation, where it would be unfair to that person or is confidential.
In this case the numbers are so small (5 or less) that the ICB believes it would be
possible to identify individuals as a result of disclosure, therefore where this is the
case this has been shown as an *.
In respect of North Yorkshire HCP, the ICB can advise that since 2021, 90 Right to
Choose requests have been received for both ASD and ADHD at an approximate
total cost of £252,000.
