We're waiting for Paul Qwirk to read a recent response and update the status.

Dear Ministry of Justice,

Review of enforcement agent (bailiff) reforms: call for evidence - people injuried, maimed or killed

Can you tell me how many people within the UK have been hurt by enforcement officers, agents or bailiffs on a yearly basis and provide all records your department holds.

Please list according to abuse. for example all those injuried and so on.

If you do not hold any records please point to who does.

Please also include details of arrests and prosecutions made against enforcement/ bailiffs/ agents/ debt collectors etc. who commit violent crimes and breach the human rights of individuals living within the UK.

Dear Weston, Bob (Gloucester),

The time period from when the enforcement bailiffs were granted powers to assault and batter people for civil debt from Certification of enforcement agents regulations 2014.

The term hurt can be bullying ( both verbal and non-verbal) , common assault, unlawful touching , battery or murder all cause harm to natural persons ( human beings) animals can also be injured as can land and property , but this request is confined to humans only and their breach of human rights. This includes causing physical pain and injury as well as being detrimental to their well being and mental health in breach of the Universal Declaration of Human Rights by enforcement officers/agents/bailiffs acting unlawfully beyond their remit.

All statutes must not be in breach of human rights and is a criminal offence if these are breached and all data and statistics you hold is required, because at least 850,000 people felt the need to complain to the citizen advice bureau etc according to the governments "Call for action" review that concluded on 19.2.2019 and confirmed that no regulator is in place to stop this vile abuse of power.

Yes, please include all those you have listed below and take into account the following information you may find useful for this FOIA request.

High Court Enforcement Officers - please note some are also Certifcated (Bailiff) Enforcement Agents.

Certificated Enforcement Agents - also can act on behalf of a High Court Enforcement Officers assigned to their company, but they have no authority to pretend to be High Court Enforcement Officer.

County Court Bailiff - there is no longer any county courts only a single county court since April 2014 now called The County Court.

The term bailif has been replaced by Enforcement Agent who must appear on the Certifcated (Bailiff) Enforcement Agent register held by single The County Court, who can also act on behalf of High Court Officers, who are assigned to particular companies.

Debt collectors do not appear on the Certificated (Bailiff) Enforcement Agent register because they are
not granted a certificate by a District Judge that sits in single The County Court at a particular county court hearing venue this would be listed next to the Enforcement Agent's name in the register, normally they work for a particular company that is also listed. Debtor collectors have no authority to pretend to be Enforcement Agents.

County Court Bailiffs for The County Court are also not listed on the Certificated (Bailiff) Enforcement Agent register because as you state they are in fact employees of HMCTS and public, rather than working for private companies or self employed as Enforcement Agents can be.

This FOIA request that was sent on 19.3.2019 and is in plain English and both clear and concise, the average man or woman in the street can easily see what information is being asked. The time period was given on 16.6.2019 as 2014 and a definition of the term hurt provided.

Further clarification was provided on 12.8.2019 in reply to the MOJ email 8.7.2019 , yet now on 10.9.2019, 6 months later you ask for even more clarification. People reading this could assume that the MOJ is deliberately delaying because they do not wish to disclose any records of Human Rights abuses that are in clear breach of the Universal Declaration of Human Rights that have been allowed to occur unfettered within the court system.

I believe that the Information Commissioners Office will not look too favourable upon further delays and countless clarification requests that could have been asked for much earlier and have already been answered.

The MOJ must hold recorded information regarding the damage that has been done to human beings and their property by those it registers as enforcement agents and enforcement officers and those employed directly by the courts and any punishment or prosecutions as a result of their criminal actions.
