Dear Aberdeen City Council,

As you know doubt know, under most circumstance when a business is flying a flag they should be paying for a licence to do so and this should result in a fairly large amount of money incoming to the council.

Could you please confirm what income you have received in the last 5 years (totalled per year) for this. Companies like Maersk (altens) are flying 3 flags on flagpoles much higher than the regulations for 'free' allow and so each such company should be licensed.

If you are not licensing these at this time please details what your plans are to ensure that the law is followed and the flags are licensed correctly

We have discussed this with number of services within Aberdeen City
Council and no service is aware of any requirement for a paid licence.
Could you please clarify if you mean a ‘formal planning permission’ is
required to fly a flag in certain circumstances ?

 

Clarifying these points will help us to be sure we are providing, where
possible, the information you are interested in.  Please note we will keep

Dear Foi Enquiries,

There are two legal stipulations that apply here as I understand it.

1 - Structures above 3m require planning consent and the corporate bodies that are flying multiple flags are normally well in excess of this

2 - Where the flag is not a national flag, advertising consent is required (and I understand that there is a fee to apply for this) . This should be revenue that the council is receiving and alsp making sure that some standards are applied.

City Council (ACC) has completed the necessary search for the information
requested.

 

1.Could you please confirm what income you have received in the last 5

ACC does not hold a record of income from flag flying licences for the
last 5 years.

 

ACC is unable to provide you with information on what income ACC has
received in the last 5 years for issuing flag flying licences as it is not
held by ACC.  In order to comply with its obligations under the terms of
Section 17 of the FOISA, ACC hereby gives notice that this information is
not held by it. 

 

Flags are treated as advertisements for the purposes of the planning
regime/system in Scotland, and the guidelines set out within The Town &
Country (Control of Advertisements) (Scotland) Regulations 1984 would
determine whether or not the erection of  flagpoles/flags on business
premises would require formal Advertisement Consent. Business premises do
not require to obtain a licence from the Local Authority to erect a
flagpole/flag.

 

Certain flag types (i.e. National, Patron Saint, Commonwealth, European
Union etc.) would normally be considered as having ‘deemed consent’  and
can, under normal circumstances, be erected without the need for formal
Advertisement Consent, however is still possible for businesses to erect
other types of flags which do not fall into the ‘deemed consent’ category
without the need to seek formal Advertisement Consent, providing the
flag(s) meet the requirements of the Advert Guidelines.

 

Information on the income received for the timescales specified are
available for the public to view on Aberdeen City Council’s website
through the Planning & Building Standards ‘public access’ facility. The
link to the ‘simple search’’ page’ is:

Typing ‘flag’ into the ‘Search box’ at the bottom of the page & clicking
on Search will take you to the relevant applications which are listed from
“newest to oldest”.  The date of each application can be identified by the
first 2 digits of its reference number (i.e. 161504 would be 2016 – 150937
would be 2015 etc.)

 

As the cost of Advert Applications has increased over the 5 year timescale
you have referred to, please see below the fee cost & the dates when they
were increased for your assistance.

 

January 2012                      - each application fee was £160

April 2013                            - the application fee was increased
to £192

December 2014                - the application fee was increased to the
current cost of £202

 

2.If you are not licensing these at this time please details what your
plans are to ensure that the law is followed and the flags are licensed
correctly

As detailed in the response to Question 1, business premises do not
require to obtain a licence from the Local Authority to erect a
flagpole/flag.
