Dear Mr Sittampalam
I refer to your email of 22^nd November requesting an Internal Review
regarding the above FOI request.
You made the request in the following terms on 21^st October 2010:

"Please provide a list of all applications you have received under the
"Reuse of public sector information" regulations since they came into
force.

This should include the information provided under sections 6(1)(b), (c)
and (d) of the regulations [name and address of applicant, details of what
document(s) were requested and the
stated purpose], and copies of any replies sent to such applications.
The last date for compliance with the time for compliance specified in
Section 10 of the Act was 18^th November. As no response had been sent to
you by that data my finding is that the Council therefore breached section
17 of the Act by failing to provide a decision notice within the time
specified in Section 10.
We are now in a position to respond to your request and would apologise
for the delay. Our response is that whilst information is held the request
is exempt from the right to have the information communicated to you
because we estimate that the costs of identifying what information is
held, locating, retrieving it and, where appropriate extracting it, is
likely to exceed the Appropriate Limit, which for local government is set
at -L-450. You are no doubt familiar with how this is calculated, but in
short it gives 18 hours to undertake those operations.
We do have a central system for managing re-use requests and we are
enclosing all the information we have been able to trace based on this
system, but we are applying the appropriate limit because we are not
confident that every request for re-use has been recorded centrally. We
operate a devolved system for responding to FOI requests and this means
that in practice requests for re-use could be made direct to the services
which were the source of the information. Given the number of service
units within the Council and the organisational changes which will have
taken place over the period of the request we are confident that a full
search would exceed the limit.
The information which we can disclose to you under the duty to provide
help and assistance is attached in the form of a spreadsheet. Personal
data has been redacted.
If you are not content with the outcome of the internal review, you have
the right to appeal directly to the Information Commissioner for a
decision. The Information Commissioner can be contacted as follows:
