FOI, England (NHS ENGLAND), NHS England

Dear Mr Whittaker,

Re:      Freedom of Information request (Our Ref: FOI-022683)

Thank you for your Freedom of Information (FOI) request dated 24 October
2016.

Your exact request was:

“Dear NHS England, with regard to Retrospective Review of Continuing
Health Care in England please answer the following questions...

1. How many people in total submitted claims across the 211 CCG's.

2. How many of those claims were successful.

3. How much in total has been paid out to successful claims.

4. What questionnaire was used by the 211 CCG's to obtain information from
the claimants.

5. What checks were made by NHS England to ensure a fair and full
assessment by all 211 CCG's 6. What will happen to the money that is left
over from your Pooled Budget Fund that all 211CCG's have added to for this
Retrospective review.”

NHS England does not hold this information.

It may help if we explain that the term “review” within the National
Framework for NHS Continuing Healthcare (NHS CHC) and NHS-funded Nursing
Care (2012) refers to:

• The process of reviewing eligible cases to reassess care needs to ensure
needs are being met and packages of care remain appropriate and effective.

Or

• A review of an eligibility decision in the event that the individual or
someone acting on their behalf disagrees with it.

For the purposes of this request we have taken the term “retrospective
review” to mean the latter and we can confirm that NHS England does not
hold this information.

This information may be held by individual Clinical Commissioning Groups
(CCGs). As such, you may wish to redirect your enquiry to individual CCGs.
You can find CCG contact information on the NHS Choices website at the
following web link:

·         [1]http://www.nhs.uk/ServiceDirectories/Pag...

If however, your request for information was for something different
please can you provide further clarification as to what is meant by the
term “retrospective review”.

We hope this information is helpful. However, if you are dissatisfied, you
have the right to ask for an internal review by writing to us, within two
months of the date of this letter, to:

Dear NHS England,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of NHS England's handling of my FOI request 'Retrospective Review of Continuing Health Care'.
To say that NHS England does not hold this information is ridiculous. NHS England are in control
of all 211 CCG's in England, they have all contributed to the Pooled Budget Fund and you have
those details which I obtained using FOI,but you dont know about a nationwide Retrospective
Review of Continuing Health Care...unacceptable. Once again the NHS are being economical
with the truth on a subject involving tens of thousands of claims. I have the results from many
CCG's regarding Retro Review and they are a disgrace, with the absolute minimum of
successful claims, you should publish a complete list of results from all 211 CCG's on this
matter so that the public who are paying for this can see exactly where all the money has gone.

The FOI management team have reviewed your request and this letter
provides an outcome of this review.

It was noted that your original response was issued within the statutory
guidelines of 20 working days.

The FOI management team have also assessed whether you had received an
appropriate response to your request. As explained in our response dated
14 November 2016, for the purposes of this request we have taken the term
“retrospective review” to mean a review of an eligibility decision in the
event that the individual or someone acting on their behalf disagrees with
it and as such, NHS England does not hold this information.

In-line with the above, the original FOI response is being upheld.

If we have misinterpreted your request or if your request for information
was for something different please can you provide further clarification
as to what recorded information you are requesting from NHS England.

We hope that this satisfactorily addresses and explains our handling and
response to your FOI request. However, if you are not content with the
outcome of the internal review, you have the right to apply directly to

Dear FOI, England (NHS ENGLAND),
Once again I find myself having to explain to NHS groups what
Retrospective Review of Continuing health Care is? Why dont you
check any CCG website and search for RRoCHC,it's easy,it's there
in black and white, all 211 CCG's are involved but you dont know.
I have now reached the stage where I believe NHS groups are
deliberately delaying giving out information and the reply given
in FOI 022683 is proof positive of this. Somebody please just
answer the simple questions about Retrospective Review of
Continuing Health Care I asked and stop hiding behind the
sections of FOI act.
Please show this to higher management and see if they have
ever heard of Retrospective Review of Continuing Health Care
as advertised in early 2012 by Government and NHS and is
still ongoing today.

Yours sincerely,

Kevin Whittaker

FOI, England (NHS ENGLAND), NHS England
