Retrospective Public Inquiry into numerous deaths at West Sussex care home - 'Orchid View' since 2010

The authority would like to / has responded by postal mail to this request.

Dear West Sussex County Council,

Once the outcome is known of the current police investigations of numerous deaths/events at a number of Sussex Healthcare homes, would it be possible for West Sussex County Council to retrospectively include the events at the previously owned Southern Cross care home, Orchid View, along with any new public inquiry into the current spate of deaths?

Yours faithfully,

Judith Charatan

Dear Ms Charatan,

Thank you for your enquiry, which has been forwarded to the appropriate
officers for a response. The usual timescale for a response is twenty
working days, that is by or on 28.11.17.

If for any reason the Council needs to extend this timescale you will be
notified in accordance with the relevant legislation.

Please note that in 2012 the County Council adopted a position in
principle that FoI and EIR requests to West Sussex County Council and the
Council's responses may be published on the Council's website in a
suitably anonymised form. This is in addition to the individual response
to the requestor, and in line with the Council's commitment to
transparency and open data.

Yours sincerely,

Helen Thompson.

Dear Ms Charatan

I refer to your request dated 31^st October and confirm that it has
been considered in accordance with the provisions of the Freedom of
Information Act 2000.

Your request was in the following terms “Once the outcome is known of the
current police investigations of numerous deaths/events at a number of
Sussex Healthcare homes, would it be possible for West Sussex County
Council to retrospectively include the events at the previously owned
Southern Cross care home, Orchid View, along with any new public inquiry
into the current spate of deaths?”

The Freedom of Information Act allows requests to be made to public
authorities for disclosure of information held.  Your request seeks
comment upon what actions West Sussex County Council may take in the
future and as such, does not contain a request for disclosure of
information held.  Your request does not therefore fall within the remit
of the Freedom of Information Act and in the circumstances, it would not
be appropriate to respond to your question under the FOI provisions.
However I can confirm that your email has been passed to Avril Wilson,
Executive Director of Children, Adults, Families, Health and Education,
who will respond to you personally in respect to the questions you raise
in your request.

If you have any queries about this letter, please contact me. Please
remember to quote the reference number above in any future communications.

If you are unhappy with the way your request has been handled, you may
wish to ask for a review of our decision via [1][email address].

If you are not content with the outcome of the internal review, you may
apply directly to the Information Commissioner for a decision. Generally,
the ICO cannot make a decision unless you have exhausted our internal
review procedure. The Information Commissioner can be contacted at:

The Information Commissioner's Office,

a search for the information which you requested and I confirm the
