Retailers of exclusive scratchcards

We're waiting for YS to read a recent response and update the status.

Dear Gambling Commission,

Under the Freedom of Information Act (2000), I would like to request the full name and full address of each of the national lottery retailers that sell the following games:

1. £5,000 Exclusive (A)
2. £50,000 Exclusive (B)
3. £150,000 Exclusive (C)
4. £250,000 Exclusive (D)

I would like the information to be delivered in Microsoft Excel format with the following columns:

Business Name, Business Address, Games Sold.

For example, if NoName Company of 62 Wonderland Drive, XYZ 123 sells 250, 000 Exclusive and 50,000 Exclusive, they should be shown in the Excel file as:

Business name (NoName Company), Business Address (62 Wonderland Drive, XYZ 123), Game sold: B,D.

If further clarification is needed, please do not hesitate to contact.

relating to scratchcards.

 

Having completed a check of our records, I can confirm that the Commission
does not hold information you have requested so unfortunately we are
unable to help you with this request.

 

The Commission is responsible for licensing and regulating the National
Lottery, ensuring the interests of participants are protected and
maximising returns for Good Causes, we do not hold information regarding
the specific scratchcards that are on sale at different retailers.  

 

Camelot, as the operator of the National Lottery, deals with the
operational aspects of games and supplying retailers.  The information you
have requested it is not something that we collect from Camelot in support
of our regulatory functions. 

 

 

Review of the decision

 

If you are unhappy with the service you have received in relation to your
Freedom of Information request and wish to make a complaint or request a
review of our decision, you should write to FOI Team, Gambling Commission,
4th floor, Victoria Square House, Victoria Square, Birmingham, B2 4BP. 

 

If you are not content with the outcome of your complaint, you may apply
directly to the Information Commissioner (ICO) for a decision. Generally,
the ICO cannot make a decision unless you have exhausted the complaints
procedure provided by the Gambling Commission.  The ICO can be contacted

Thank you for your response, however, I do not know that I believe that "the Commission does not hold information" I requested.

A similar response was given to the request here: https://www.whatdotheyknow.com/request/l....

In this same instance (above), the Gambling Commission tried to avoid providing information re: location of national lottery terminals, by stating that (the information was) "commercially sensitive nature and it contains personal data."

However, after intervention and adjudication, the information was indeed provided by the Gambling Commission in 2016 (https://www.whatdotheyknow.com/request/l... and 2017 (https://www.whatdotheyknow.com/request/n....

Thank you for your email.

The Freedom of Information Act 2000 (FOIA) places a legal requirement on public authorities to confirm whether requested information is held in response to a request, unless an exemption to that requirement applies. Whilst we do hold information regarding Camelot and the retailers that sell their products, we do not collect all of the information regarding their operations as we have no reason to do so. We only collect information where it is required for us to perform regulatory functions (such as the monitoring of overall sales so that we can ensure that money is being returned to good causes).

Were we to deliberately hide requested information, we would be in breach of the legal obligations placed upon us under the FOIA. For information that is sensitive and not suitable for public disclosure, the FOIA provides a number of exemptions which can be applied (where it satisfies the requirements to apply an exemption).

With the request you have referred to below, we considered that this information was not suitable for disclosure so we confirmed that it was held but we explained why we did not think it should be released. The requestor did not agree with this decision so it was appealed. The decision was then overturned so the information was disclosed.

If we did hold the information you requested but considered that it was exempt for some reason, we would have confirmed that it was held but explained why we decided not to disclose it.

I hope this makes sense but please contact me if anything is unclear.

Can you share what other options might be available?

These exclusive scratchcards are only sold in select locations.

It is not feasible (and ridiculous, actually) for me to go around from store to store to try to figure out which stores sell these exclusive scratchcards (not that you stated that this is what I should do).
