Dear C Taylor,

Thank you for your response, which I assume is a preliminary update. I believe that under section 10 of the Freedom Of Information Act (FOIA) you are obliged to provide a response which is compliant with FOIA sction 17 within 20 working days.

FOIA s17(3)(b) places a duty on your Trust to explain exactly which exemption you are relying on if you are refusing to provide information. You have not given me the reasons for not providing the information and I am not sure which exemption you are using when you do not provide the information?

If you were considering using s22 as the basis of refusal there are a few points you might need to consider.

· S22 might apply if I had requested a copy of a report which is still in draft format, however the information I requested is entirely objective and factual in nature. By its very nature, this information should not change in any way prior to publication. It's hard to see how s22 is therefore engaged in the first place.

· For s22 to apply the Trust must have already formulated plans for the publication of this requested data, even if it has not been possible to finalise the date of this publication. Can I ask what actions need to take place before publication can take place? Can I see the publication schedule or plan? If this schedule has dependencies outside the Trust's control can you let me know what these dependencies are?

· S22 is a qualified exemption. This means your Trust must explain why, after objectively balancing the arguments both for and against disclosure, you feel the overall public interest is best served by not releasing this information.

I probably don't need to mention it, but it would be a criminal offence under section 77 of the FOIA to alter or lose records or information, with intent to prevent disclosure.

Dear Joanne, 

We are refusing your FOI request under the exemption- Section 22/22a.

 

The reasons for this is that we are intending to take the results of the
parental consultation to our Directors on January 17th 2017. At this
meeting the Directors will consider the available information which at
present is yet to be collated. We would be happy to share the report and
paper from that meeting with you on January 18th 2017.

 

There has been an initial letter sent out to parents and is available on
the Meopham School website. In addition an article has been published in
the TES last week (2/12) which the Trust contributed to.

 

We do not have an internal review procedure regarding FOI requests.
However, the CEO of Swale Academies Trust is aware of this request and
will be attending the Directors meeting to discuss this matter.

 

You have the right to complain to the Information Commissioner’s Office:

Dear Joanne,

The results from the consultation showed a 50/50 split. Therefore, the decision from the Trust has been to introduce a grammar stream into Year 7 from September 2017 at Meopham School. The intention for Meopham School to become a grammar school is currently under review by the Directors of the Trust, however, this decision is subject to any impending legislation.

If there were replies that allowed the school to approximate an outcome then those replies must have been counted at some time, and these replies held by the school.

It is a criminal offence under FOI legislation to deliberately destroy, hide or alter requested information to prevent it being released.
