Dear Ms Cantrell,

I am in receipt of your response to my FOIA Request.

1. I have asked for the results of a consultation which should be freely available to the public, anyway.
2. Your consultation was conducted anonymously in its entirety, so it is hard to see how any exemption could apply to named persons, as there won't be any.
3. If you wish to provide copies of Minutes and anonymise councillor's names, that is perfectly acceptable. I have not requested - and do not require at this stage - any names, thank you.
4. No charge should be payable for this information, particularly given that it should be published by the Council, anyway.
5. The deadline for the information is 24th November, after which I will be contacting the ICO.

still live on the website, there is no timetable as yet, as to when the
results will be analysed.

2.  Analysis of all results.  No analysis has yet been undertaken with
regards to this survey

3.  Minutes of subsequent meetings where decisions are taken as a result
of the consultation.  The consultation is currently still live on the
website, once results are known then they have to follow due process which
will result in ratification from senior management and members before the
results are published.

I think it is fair, therefore, to allow an extra fortnight on top of the original deadline date, to allow the Council ample time in which to provide the information I have requested.

The consultation has now closed but as previously advised the results have to be taken to Senior Management Team and due to other more pressing matters this has been delayed until the Januarys meetings, once they have seen the results and had time to comment on them, they will be published in thereafter on the website.

You MUST, by now, be in possession of the facts I requested regarding the outcome of the consultation, and at least some of the information requested regarding the council's decision.

I wrote to you more than a week ago, asking whether you had the information I have requested, and requesting an update on your progress in making it available to me.

I have had NO reply.

This FOIA Request is now LONG overdue, and the Council is breaking the law by failing to provide the information requested. I feel I have been more than gracious, in allowing you many weeks of extra time to provide the information. However, since you have chosen to IGNORE my last communication to you, I am writing to advise that if the information is not in my possession by Friday of this week, I will be reporting the Council to the Information Commissioner's Office.

I have looked on your website and can find no information giving the final results of the consultation, OR any information about decisions taken at meetings since the consultation closed. Therefore, I need you to send it through to me, please.

For your convenience, I have copied the information I requested below:

We have not ignored your previous emails, I am simply trying to find out when this consultation will be going to go to Senior Team.

Due to staff working hours I am struggling to find out when this is going to be submitted to Senior Team to be ratified.

We were hoping this was going to be in January, but this has not been the case.

Unfortunately if we do not currently hold the information we cannot release it.

No timelines were given as to when the results might be published.

I can only assure you that when the information is ready to be published we will let you know.

Dear Ms Cantrell

I am sure that by now, some of this information must have been processed! It is difficult to believe that it can have taken this length of time to assess responses.

I do appreciate that you are struggling to obtain it, but when you didn't reply to my previous communication, I felt that you must have decided not to bother.

This Request is now more than 40 days late and well past the time I should be reporting it to the ICO. However, since you state that you don't yet have the consultation results available, it seems there isn't much that can be done.

If the information isn't forthcoming soon, I will have no option other than to contact the ICO for their advice. However, if you are prepared to honour your assurance that you will send the information as soon as it is available, I am prepared to wait a little longer.

I would however stress that no analysis has taken place as yet, and to my knowledge has not been programmed in, in the short term. This is due to resource issues within the Council.

Also no meetings have been booked in for the same reason as above.

I think that in fairness to you, it is best if I close this FOIA request for now and contact you with a new one in about a month or so, when hopefully you will have either the analysis and Minutes of meetings to send me, or some idea of when these might be available; and we'll be starting afresh with the Request, so it will give you more time anyway.
