Dear Belfast City Council,
The information I have requested is environmental information, as defined in Regulation 2(1) of the Environmental Information Regulations, it is exempt from disclosure under Section 39 of the Freedom of Information Act 2000. However, I want our Council to consider my request under regulation Section 74 of the Freedom of Information Act to consider my request under the Environmental Information Regulations 2004, which gives me the public qualified rights to access to environmental information held by a public authority. I wish our Council therefore to considered my request under the Environmental Information Regulations.
1.Do EHOs or senior members of our council believe EHOs are suitably trained and qualified to carry out the inspection of Gas Catering premisses even though our EHOs have NO gas related qualifications such as the basics of CCN1 ?
2. How can EHOs ensure compliance and certification of gas catering establishments when the fuel they are using (LPG/NAT GAS) is not being identified ?
3. Why is the fuel type not identified by our councils as there are different regulations of compliance pending on the fuel type such as ventilation and injector sizing?
4. Do our council EHOs check to ensure the appliances installed in catering establishments are British Standard Kite marked and are designed for the particular gas being used ?
5.Do our EHOs check for emergency isolation valve/valves for the premisses they are inspecting and they are identified and operating correctly?
6. Do EHOs have a check list for commercial premisses such as a pilot has for there "Pre Take Off" check list this ensures nothing is missed when distracted ? if so send me a copy if not why not?
7. How can our councils who are charged to ensure public safety in gas catering premisses who check and inspect these establishments who have no gas qualifications is it not just a matter of time given the councils lack of understanding in gas appliances, fittings, maintenance, servicing and inspections that more explosions and deaths are on the horizon and its not if but when the next one will happen?
8. what are our councils doing to plug the major void of understanding of Gas associated appliances, what steps are our councils taking to exhaust all avenues to ensure public safety is a priority?
9. Do our councils believe they are doing everything they can possibly do to ensure public safety in gas establishments to minimise the risk of explosions, leaks and Carbon Monoxide poisoning if not what additional improvements can you do to improve safety?
10. Given the resent explosion in commercial premisses what additional safety implementations have our council adopted to ensure there is not a repeat of this and what lessons have been learnt by our council to ensure gas safety is being taken seriously by our council?
Dear Belfast City Council,
This is the second submitted request which has passed the "long stop" deadline and you have acknowledged my request but failed to provide me with the information of which i am legally obliged too.
i now request a full review as to why the requested information has not been forthcoming in line with the MAXIMUM 20 working day criteria.
This is totally unacceptable and not in line with current GDPR regulations and also breaches Parliamentary Ombudsman Office legislation, please hold these records should the need for the intervention of the ICO be required.
i now look forward to this information i will now give our Council a further 3 working days after this period i will lodge a complaint under "casework" for the ICOs judgment and intervention.

I refer to your email, below, sent on 16 October 2018 at 09:22 requesting an internal review of the Council’s handling of a request for information you submitted in an email received by the Council on 17 September 2018. You complained that the Council had failed to respond to your request within the statutory timeframe.
As stated above, your request for information was received by the Council on 17 September 2018. It was deemed to be a request for environmental information and was, therefore, considered under the Environmental Information Regulations 2004. Under the Regulations the Council was required to respond as soon as possible and no later than 20 working days after the date of receipt of the request.
I should explain that the first working day response period begins on the working day after receipt. In this case, the first working day for response purposes was 18 September 2018 and the twentieth working day was 15 October 2018.
Mark McGovern, Senior Environmental Health Officer, Belfast City Council, sent you an email on 15 October 2018, with the Council’s response to your request, signed by Valerie Brown, Environmental Health Manager, attached. However, I note that Mr McGovern sent the email to a personal email address you had furnished him rather than to the whatdotheyknow.com email account which you used to submit your request and asked the Council to reply to. I also note that Mr McGovern sent his email of 15 October 2018 at 20:37, which is outside normal office working hours. In addition, Mr McGovern attached the Council’s response to another request for information, which you submitted in an email sent on 7 September 2018. The Council apologises for any inconvenience or confusion this may have caused you.
Mr McGovern has advised me that he had a telephone conversation with you on 16 October 2018 and that on him explaining the situation you were content with the Council’s response. I trust that this brings this matter to a close, but should you have any queries about this email, please contact me.
