Dear Cambridge University Hospitals NHS Foundation Trust,

Following the announcement from HMRC requiring VAT be paid on agency doctors supplied to the trust by Brooksons/+us, can you confirm;
1. Whether agency doctors are still being, (a) mandated to or, (b) requested to work through the Brooksons/+us shell arrangement?
2. Whether the trust intends to seek compensation for breach of contract by Brooksons/+us and /or rely on any indemnity provided by Brooksons/+us should HMRC seek to recover backdated taxes?
3. Whether nationally procured contracts endorsed by NHS Improvement and HM Treasury will now be used by locum services from one or more agencies or a neutral vendor?
4. Whether the trust intends to use a newly modified service with the same provider to try to continue to avoid or mitigate VAT, and please share any legal and tax advice that you have sought?
5. Whether the trust considers the contract with this provider is void on the basis that the contract specification can no longer be met and any changes proposed to the supply model would be so material as to render it void?

I note that the response to Roy's FOI was stalled on a technicality when clarification was requested to question 3, which stops the clock and, unless he responds allows the trust to avoid answering.

I provided feedback to Roy about this publicly via the website, however he appears not to have noticed this, and I thus wish to take over the request myself (whether as a further request or taking over as requester on the existing one).

With respect to your request for clarification - please ignore question 3 of the request and answer all others, I am not interested in this response. Should you require further clarification please contact me within 48 hours as per ICO guidance.

I would also like to request all internal documentation/emails/information in a recorded format related to the processing of Roy's FOI - please consider all fowarded emails within discussion and attachments as within the scope of the request. Feel free to include repeat emails more than once if it reduces the processing time for this additional Freedom of Information Act 2000 request.

With respect to both requests could all deletions please cite any exemption it is asserted applies - including the specific subsection relied upon, where these are qualified exemptions please disclose the full public interest reasoning with respect to failure to disclose information about tax avoidance schemes (Direct Engagement Schemes) in use by the trust and where relevant prejudice tests. All non-exempt information is to be disclosed please.
