Response from drainage boards in relation to the East Chatteris BCP
Dear Fenland District Council,
The Nightlayers Internal Drainage Board minutes for May 2022 include a report from the Consulting Engineers that says:
"On a strategic basis a response was provided to the District Council on the Broad Concept Plan for this area in March 2017 but it is not known if the Boards comments were considered or implemented."
It does not appear that these comments were made public at the time that the East Chatteris BCP was put before the planning committee in June 2017.
As soon as practicable, please can you provide a copy of the submission from the IDB/Middle Level Commissioners or their representatives?

Thank you for acknowledging so quickly.
Thinking about it a little, I wonder whether this should be dealt with under the EIR regime rather than FOI.
The EIR define Environmental Information as:
"(a) the state of the elements of the environment, such as air and atmosphere, water, soil, land, landscape and natural sites including wetlands, coastal and marine areas, biological diversity and its components, including genetically modified organisms, and the interaction among these elements;"
"(b) factors, such as substances, energy, noise, radiation or waste, including radioactive waste, emissions, discharges and other releases into the environment, affecting or likely to affect the elements of the environment referred to in (a);"
It seems to me that information about the discharge of surface water into a watercourse, especially where this could relate to elements such as flooding, is more likely than not to fall under the category of "environmental information".

Please can you give me an indication as to when I will receive a response to this request?
I believe that the 20 working days period for a response expired yesterday (15th February). The Environmental Information Regulations stipulate strict time limits for responses, with less scope for an extension of time than available under the FOI regime. The only such exemption is if the information requested is too complex or the volume of information is significantly large, but I do not feel that this exemption would apply here.
