residents consent to pass their data to Npower Ltd

Dear Sheffield City Council,

In relation to the contract between NPower Ltd & Sheffield City Council, Carbon Dioxide Saving Agreement 2011-2012, Funding/Scheme No. NPLE11M26 Hanover & Lansdowne.

Page 30 Section 25 subsection 25.1 states the following:-

"The Social Housing Provider shall ensure that each Data Subject (including, without limitation, Residents) receiving the supply and or installation of Physical Measures provided by or on behalf of the Social Housing Provider and submitted onto the System is aware that their Personal Data and information and details they provide shall be passed to Npower and used and disclosed by Npower in accordance with the provisions of this Agreement. As such, the Social Housing Provider shall ensure that Residents are made aware of and have consented"

Could you therefore supply the following information.

PLEASE NOTE: The word residents relates to EVERY INDIVIDUAL (adults & children, tenants & leaseholders) living on or in a property on the relevant estates

1) How many residents are there currently on the Lansdowne Estate?

2) How many residents on the Lansdowne estate were specifically told about their personal details being passed to Npower for them to use/sell as NPower see fit?

3) How many residents understood this and signed the relevant documents?

4) How many residents REFUSED to sign the document allowing SCC to divulge their information to NPower?

5) Those that refused to give such consent, have they received the CO2 saving measures to their home?

6)How many residents are there currently on the Hanover Estate?

7) How many residents on the Hanover estate were specifically told about their personal details being passed to Npower for them to use/sell as NPower see fit?

8)How many residents understood this and signed the relevant documents?

9)How many residents REFUSED to sign the document allowing SCC to divulge their information to NPower?

10)Those that refused to give such consent, have they received the CO2 saving measures to their home?

Dear Terry,
I have experienced a poor and incorrect response from this lot before. I wonder if you are aware that SCC 100% own Sheffield Homes.
They have been told by the ICO about doing this before. I think they are playing for time as you have caught them out.
SCC own SH and can request the info from them. This excuse is an outrage.

The contract is between SHEFFIELD CITY COUNCIL & NPOWER LTD, not Sheffield homes & Npower Ltd.
There is no mention of Sheffield homes in the contract from which I am asking for you to provide the relevant information.

Are you trying to say that the contract mentioned in my FOI is bogus and does not exist between your organisation & Npower?

Please disclose the information I have asked for within the next 7 lunar days to avoid me taking this to the information commissioner.

The contract is between SHEFFIELD CITY COUNCIL & NPOWER, it is therefore SHEFFIELD CITY COUNCIL WHO ARE RESPONSIBLE FOR ANSWERING & PROVIDING INFORMATION RELATING TO MY FOI REQUEST PERTAINING TO THE AFOREMENTION CONTRACT.

I am aware that Sheffield Homes is 100% owed by SCC. I had an idea they would give me the run around because they are in breech of the law on a catastrophic scale. I for one am fully aware they never got my consent or that of a number of my neighbours.

Dear Terry,
This response is a joke and the council are trying to buy extra time to organise a wriggle. I seriously suggest you send this to the information commissioner.
I have had similar rubbish replies and the council alleged this is an area they would try to resolve! Oh dear, it would appear this has not come to fruition.

PS Are they not breaching the data protection act?
This is worth looking into.

You recently requested further clarification on the information we sent
you regarding the sharing of personal information with Npower. I am sorry
if our first response was not as clear as it could have been.
Please find below further answers, as requested:

1) You did NOT collect any data?
We did collect data. It is a requirement to submit data about properties
including an address and the measures installed at those properties. This
is not classed as personal data under the Data Protection Act 1998 and
section 25.1.
2) You have NOT used the rent system or electrol role system or
council tax system to acquire the relevant data asked for by N
Power on page 30 section 25 sub section 25.1?
Section 25.1 does not refer specifically to providing Npower with rent
system, electoral role system or Council tax system data. For the purposes
of the project which this agreement relates to no personal data was
collected and therefore providing any such data to Npower is not
applicable.
3) Npower has released you from that obligation which is written
into the contract?
Not applicable - no personal data has been collected therefore we have
neither fulfilled it or been released from it

Just thought I would give everyone an update.

Sheffield City Council & Sheffield Homes (a wholly owned subsidiary of SCC) have both confirmed that they HAVE NOT passed on residents details to NPower, however, today I have been privy to a document from SCC Legal Department that confirms residents details HAVE been passed to NPower, without residents consent.

It appears that even though we have the FoI Act some organisations clearly give FALSE answers to questions raised, especially those that have legal implications that can carry heavy fines and imprisonment. So please be aware that the information you get may be just political or PR spin
