Thank you for your request for information above, which we have dealt with
under the terms of the Freedom of Information Act 2000.

I hope the following will answer your query:

Please see spreadsheet attached.

Please note full address details are not included. I can confirm that the
council holds this information; however this information is exempt under
section 40(2) of the Freedom of Information Act 2000.

The full addresses are withheld as it constitutes personal information as
defined in Part 1, Section 3 (2) of the Data Protection Act 2018. In
considering the exemption for personal data under s 40(2) of the Freedom
of Information Act, we need to consider whether disclosure of personal
information would contravene any of the data protection principles.

The Principles relating to processing of personal data at Chapter 2,
Article 5, 1(a) of the General Data Protection Regulations state:

“Personal data shall be: (a) processed lawfully, fairly and in a
transparent manner in relation to the data subject (‘lawfulness, fairness
and transparency’).”

The lawfulness of processing at Chapter 2, Article 6, 1(a) of the General
Data Protection Regulations state:

“Processing shall be lawful only if and to the extent that at least one of
the following applies: (a) the data subject has given consent to the
processing of his or her personal data for one or more specific purposes”

This information will relate to individuals who may be identifiable, at
minimum as council tenants. The individuals in question have not consented
to this information being disclosed. It is not reasonable in all
circumstances to disclose this information without their consent or
knowledge as they would not have an expectation that this information
would be publically disclosed as this was not the original purpose of
processing the information. Therefore any disclosure would be unlawful and
unfair and so in breach of the data protection principle.

This information is therefore exempt from disclosure under s 40(2) of the
Freedom of Information Act. This is an absolute exemption and there is no
requirement to consider the public interest.
