EGD - Freedom of Information, Cornwall Council

Dear Mr Evans,

Your request under the Environmental Information Regulations 2004.

Thank you for your request for information regarding data for all
residential properties, which we received on 15/08/18, and which falls
under the Environmental Information Regulations 2004 “eir”

We want to be as open as possible in answering requests and to help people
obtain the information they are looking for.  Unfortunately, in this case
before we proceed to process your request we need to clarify the
information that you require as we are not entirely clear on aspects of
your request.  This means that we will unfortunately have to refuse the
request as it stands, under Regulation 12(4)(c) of the EIRs (relating to
requests that are formulated in too general a manner) until the relevant
clarification is received as detailed below.

As Regulation 12(4)(c) is a qualified exemption, a public interest test
has been applied. In applying this exception we have had to balance the
public interest in refusing the request and seeking clarification of the
information requested, against the public interest of dealing with the
request as it stands and diverting resources and time to obtaining and
disclosing information that may not be what was actually required.
Therefore in conclusion, we are of the opinion that the balance of public
interest favours seeking clarification so that resources can be focussed
on providing you with the correct information and accurate response,
rather than staff time being spent on obtaining and providing information
that you did not require.

Unfortunately we are unable to proceed with your request due to how
information is held on our systems. However, we may be able to assist you
with your request if you are able to provide specific
addresses/residential properties that you require information for.

In light of the above please contact me to let me know if you would like
the Council to proceed with your request. This being the case the
confirmed details will be logged as new request with a further 20 working
day deadline.

Please note that there are some instances where a charge may be applied
for the supply of environmental information under the EIRs. More
information can be found on the Freedom of Information advice page of the
Cornwall Council website under the EIR Fees and Charging Policy.

Cornwall Council is committed to open and transparent government and
provides information to members of the public about all aspects of the
authority.

We deal with around 2000 FOI/EIR requests for information each year, with
the cost to the Council ranging between £25 and £450 per request. You may
be able to find the information by checking previous responses on our
Disclosure Log, the Council’s Publication Scheme, or by checking the
Council’s website at www.cornwall.gov.uk.  Therefore if you do
subsequently find the information you require by this method and no longer
wish us to process your request, please do let us know.

Please do not hesitate to contact me should you have any further queries,
remembering to quote the reference number above in any future
communications.
