“By full address (i.e. house number/name & full postcode area), can you please provide the following data for all residential properties within your respective district area in an spreadsheet format (Excel etc)?
- Property Type (House, Flat etc)
- Property Style (Detached, Semi Detached etc)
- Number of Bedrooms
- If a flat, how many storeys? (Where Applicable)
- If a flat, what cladding was used? (Where applicable)
- Date of Construction
- If property is of Non-Traditional construction (Where applicable i.e. Wimpey No Fines, Airey)
- If any property is Non-Traditional construction, has a repair certificate been issued and if so what was the data of issue? (Where Applicable)
- If the property is ex-Local Authority (Where applicable)

Freedom of Information: an introduction

The Freedom of Information (Scotland) Act 2002 gives a general right of access to the information held by a broad range of Scottish public authorities. The Act covers the Scottish Executive, local authorities, health boards, universities, police forces, and a large number of other public bodies.

FoI Policy

East Renfrewshire Council adopted a Freedom of Information Policy in December 2004. This commits the Council to properly dealing with all information requests. The Policy established a cross-departmental Freedom of Information Working Group, and emphasises the departmental nature of the responsibility for dealing with Freedom of Information Request. Legal Services provide the lead in terms of establishing procedures, etc., and will also deal with any cross-departmental requests.

Publication Scheme

The Council has produced a publication scheme, available from our website or from our libraries. This document lists all the classes of information that we make available, as well as information about the format of the information and how you can access it.

Making a request for information

There may be a charge for more extensive enquiries, and those which cost us over £600 to process may be refused. We will endeavour to deal with your request as quickly as possible, but it may take up to 20 working days from receipt.
Please note that there are a number of exemptions under Freedom of Information. such as those relating to personal information, material otherwise available, confidentiality, commercial interest, crime and national security. If any of these exemptions are applied, we will issue a refusal notice stating the reason why you have not been given the information that you had asked for and how you can appeal that decision.

Dear Mr Hallatt
 
On speaking to colleagues across the Council, I am afraid that we would
have a number of difficulties with the enclosed.
 
Some of this information is not held. While we may hold much of the
information in respect of some of the properties, for others we do not.
 
Moreover, as you have asked for a wide range of information in respect of
a large number of properties, and as to research this information would
require a very extensive piece of work across any number of separate
systems to co-ordinate a reply, we would be obliged to issue a fees notice
before we could commence the work.
 
Some of the information, however, is available through our planning portal

I am sorry that I can not offer more, but if you were able to amend the
parameters of your request I will pass it on to the relevant section of
our Environment Department.
 
Under Section 13 of the Freedom of Information (Scotland) Act 2002, and
the Freedom of Information (Fees for Required Disclosure) (Scotland)
Regulations 2004,  Public Authorities are allowed to make a marginal
charge for larger requests.  Moreover, under Section 12 of the Act,
authorities are not obliged to comply with a request which costs more than
£600 to process. In addition, Regulation 8 of the EIR allows authorities
to charge a fee amount to the full actual cost for the provision of such
information.
 
Regulation 10(4)a of the EIR and S17 of FoI(S)A require us to formally
state that information is not held; and Reg. 6(1)b requires me to formally
state that (in relation to the Planning Information) that this information
is otherwise available as detailed above.
 
 
East Renfrewshire Council offers the opportunity to apply to the Council
for a review of how we have dealt with your enquiry. If you wish to
proceed to review, please apply in writing within 40 working days to:
