I write with regard to your request for information to St Albans City &
District Council. Your email was received by the Council on 12th July
2018.
 
Under Section 10(1) of the Freedom of Information Act 2000, we are
required to respond no later than 20 working days after the date we
receive your request.
This means that you should have a response by the 9th August 2018 . 
 
However, if we feel that we require further information to fulfill your
request we will write to inform you within the twenty day period [section
1(3)].
 
If the Council considers that we require further time to respond then we
will write to you informing you of the estimated date of response [section

case.

I write with regard to your request for information sent by letter to St
Albans City & District Council on 12th July 2018.
 
Under the Freedom of Information Act 2000, we are required to confirm what
information we hold, and if we do hold the information, disclose the
information, subject to exemptions or other provisions applying.
 
You requested:

Where the cost of complying with the request for information exceeds the
limit set out in the Fees Regulations, section 12 of the Freedom of
Information Act states that a public authority are not then obliged to
provide the information.
 
The Fee Regulations state that we can consider under Regulation 4(3)
whether we hold the information, the location of it, retrieval and
extraction from the documentation.  In assessing whether the costs exceed
the limit of £450 set out for public authorities we must use the hourly
rate of £25 as set out in the Regulations.
 
We do not hold the property data for privately own properties, this also
includes properties that are managed by Housing Association. You may wish
to contact them separately.
 
We have 6635 properties which consist of council owned and leasehold
properties. To run the report on our system we can only provide some of
the information which can take 5 hours. The rest of the information will
need to be extracted from other files. It will take at least 5mintues to
check into each property for the other requested information. Therefore
all together 552 Hours.
 
Under section 40 of the Freedom of information Act 2000 we would withhold
the property number and postcode of the addresses as that will identify
the individual. This is because we consider it would be unfair under the
Data Protection principles to release that data to you.
 
There is therefore no obligation under the Act to comply with your request
for information.
 
However in the interests of co-operation we can prepare the response but
we are entitled to charge a fee.  The fee we would propose to charge is
calculated in line with the Regulations:
                                                                                               
            
Under Section 16 of the Freedom of Information Act, we are required to
provide advice and assistance at all stages of this process.  We have
confirmed that we will comply with the requirement as set out for the
proposed fee.  You can consider whether there are alternative methods of
requesting the information you require.  This is more likely to fall
within the appropriate limit set out in the Regulations and therefore we
are more likely to be able to comply.  If you require a specific piece of
information or information for a specific shorter period of time, then you
may be able to modify your request so that response falls within the
appropriate time frames.
 
If you are dissatisfied with this response the Commissioner’s Office
recommends that you first refer the matter to the Council. You can do this
by writing to me asking for an internal review of my decision. If you wish
the Council to undertake an internal review, then you must write to the
Council within 40 working days of the date of this letter. The Council
will not consider any requests received after this date unless there are
exceptional circumstances for the delay. 
 
You have a right to appeal to the Information Commissioner's Office at the
following address: Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.
You must do this no later than two months after the Local Authority’s last
response to you.
