Dear Graham Ostle,

Thank you for your response. You refer to Freedom of Information request 844369 but your assertion is incorrect. The response was not complete at the time. I have looked at all the zip files sent again. There is nothing that immediately stands out. For example in the Housing Resident Forum 24.02.2015 (7pm).pdf there is general mention of Housing Improvement Project bids BUT no detail of those bids was sent. As I understand it every bid is listed and then it is subject to an approval. That data was never sent thus the reason for the start date of 1st January 2015 was an invitation for you to provide the full detail this time around.

As for your exemption. I note it wasn't applied under FOI 844369. Furthermore I do not think you are applying the exemptions as intended. The Investment Group is tasked with making monetary decisions and therefore the public interest test take a precidence normally not applicable. However I shall pursue this through Internal Review.

I am writing to request an internal review of Hammersmith and Fulham Borough Council's handling of my FOI request 'Resident Investment Group'.

That you have misapplied the exemption under Section 40 (2) of the act. Processing would be lawful and fair, and meet a condition of Schedule 2. In determining whether consent has been given there are three examples (there are more);

1. The current and previous chairs of the group appear mentioned by name and title on the councils website and in other meeting notes where they are identified also accessible via the councils website.
2. The group terms of reference available (https://www.lbhf.gov.uk/sites/default/fi...) i.e. points 1.3, 2.5, 3.1 and 3.4 which states "Membership will be publicised on the resident involvement webpage and provided to all Housing Representatives Forum members after the AGM".
3. You didn't redact the information or rely on exemption 40 (2) when you replied to a previous FOI your reference - 844369.

Given that the work of this group is to approve the spend of monies on behalf of the council there is a public interest test here that speaks to accountability that in turn is recognised by the group in the Terms of Reference.

1) The meeting minutes and supporting data for the meeting of 6th February 2017. This may not have been "approved" at the time of request but still would have exisited in 'draft' form and would have been approved over the period this request has been in operation.

2) You have not provided the reports and all data for the Investment Group Tours in 2016 and 2017 within the period I asked for.

The council upheld the Internal Review in my favor and accepts the premise that all this information because it involved financial matters serves the public interest test.

Please provide the missing information within the next 5 working days to avoid escalation to the Information Commissioners Office.

responding to you.

Our responses to the issues raised in that email are set out below:

Residents Investment Group Meeting of 6 February 2017

You have stated that the response to your request for information (RFI),
did not include the minutes and supporting data for the Residents
Investment Group meeting of 6 February 2017.

We have discussed this with the council’s Housing Services division, which
was involved with compiling the information disclosed in the RFI response.
Housing Services confirmed that the draft minutes of that meeting were in
the process of being approved when you filed this RFI. Therefore the draft
minutes were ‘held’ by the council at the time of the request, and should
have been included with the RFI response. Housing Services have told us
that the draft minutes were not included with the RFI response, in error.

I have attached a copy of the approved minutes for the meeting. We
apologise that this document was not included with the RFI response.

Investment Group Tours

You have stated that the RFI response did not include ‘reports and all
data for the Investment Group tours in 2016 and 2017’ within the period
covered by your RFI.

Your RFI requested documents held between 1 January 2015 and 12 March
2017. We asked Housing Services to confirm whether the RFI response
contained all of the investment group tour reports which fell within this
timeframe. Housing Services found that one report which fell within this
timeframe, had not been included in the RFI response, in error. This was
the report for the June 2016 investment group tour. A copy of the report
is attached. We apologise this report was not included in the RFI
response.

Housing Services have stated that the only other tour which occurred
during the timeframe covered by the request, was the investment group tour
of November 2016. However, no report was prepared for the November 2016
tour, as it was necessary, instead, to put available time into dealing
with issues arising from that tour.
