Residence Permit in leiu of visa

Dear UK Border Agency,

It has come to my attention that UKBA are now accepting Residence Permits issued by Germany and Estonia to non EEA Family Members as valid travel documents instead of having to apply for an EEA Family Permit.

One of the reasons given was the fact the cards were labeled correctly under EU guidelines. As such, can i expect that a Swedish resident permit, with photo ID, issued under Article 10/ 2008/EC and inline with German and Estonian standards to be acceptable also?

Will the UKBA be accepting Swedish issued residence permit for travel without a visa in line with EU law , and if not, why?

Dear Freedom Of Information Team ( IND ), Your response to my FOI request is late. Please respond to the question why Swedish Residence cards, as issued under EU Law are not accepted as travel visa as required by EU law,by UKBA(or the new entity),despite being clearly labled in English "family member of EU citizen", just as those from Germany and Estonia that are found to be acceptable. I look forward to a prompt and specific answer to my query, or shall be asking for an internal review.

The decision to accept the German and Estonia EU family residence cards
was first anounced in November 2012 to the High Court during the
JR challenge I took against the UK for refusing the abide by EU law.My
case has been refered to the ECJ for a ruling and nothing will change or
happen before the ECJ rules on the behavour of the UK on the matter.
There is a 20 page reserved judgement from the UK High Court on my
case which anyone can go on line and read,it makes intresting reading
and it will be even more intresting what the ECJ say about its contents
and conclusions.I took a similar Irish High Court action agains the Irish Government which resulted in I winning and the Irish were forced to change the law and accept all EU family member cards.

Thanks Sean for your post. As you are aware the UK goverment has seen fit to twist the rules. The response i got is typical denial. Swedish resident permits are produced and labled in line with EU law, however the UK goverment is requesting photo and biometric information before they will accept resident cards in leiu of visas. I have another petition lodged with the ECJ.
