I am writing to request details of the number of occasions where an ACAS Arbitrator has been asked to be part of a 'National Appeals Panel' for a Conduct Code case against a Royal Mail CWU Representative. I would also like to know the percentage split of the results (allowed/refused). Please could you supply data for the years 2007, 2008 and 2009.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Advisory, Conciliation and Arbitration Service's handling of my FOI request 'Requests from Royal Mail Group Ltd to provide arbitration'.

I believe that my request has been misunderstood. This is part of a national agreement between Royal Mail and the Communication Workers Union. The appeals panel is made up of a member of the union's National Executive, a Royal Mail Appeals Manager, and an ACAS arbitrator. If this information is not kept, then a simple email message sent to all ACAS arbitrators will quickly find the information, at little cost.

Dear Mr Griffin,

I have reviewed the handling of your FoI request 'Requests from Royal Mail Group Ltd to provide arbitration'.

Under section 1 of the Freedom of Information Act, you are entitled to:

''General right of access to information held by public authorities

(1) Any person making a request for information to a public authority is entitled-

(a) to be informed in writing by the public authority whether it holds information of the description specified in the request, and
(b) if that is the case, to have that information communicated to him.''

Since Acas do not hold the information as required in 1(a), we cannot comply with (b) and therefore the original response is upheld. This is a private arrangement between CWU and the Royal mail. I would advise you to take the matter up with them directly.
