Thank you for your email dated 9th July 2011 in which you made a request
for access to certain information which may be held by Northumbria Police.
As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

We have now had the opportunity to fully consider your request and I
provide a response for your attention.
Following receipt of your request, searches were conducted with the Finance
Department of Northumbria Police. I can confirm that whilst some of the
information you have requested may be held in part by Northumbria Police,
we are unable to disclose for the folowing reasons.
Firstly I have to advise you that records are not kept, nor are they
required to be kept for that period of time. Additionally we have
estimated that to locate and extract the information that is held would
take over prescibed 18 hours, therefore Section 12 of the Freedom of
Information Act would apply. This section does not oblige a public
authority to comply with a request for information if the authority
estimated that the cost of complying with the request would exceed the
appropriate limit of 18 hours, equating to £450.00
You should consider this to be a refusal notice under section 17 of the Act
for that part of your request.
However, in order to provide you with some assistance, under Section 16 of
the Freedom of Information Act 2000, you may wish to re-submit your request
for a significantly lesser time period and be more specific as to what kind
of funding information you require and from whom the funding may have been

When it comes to the 'Martin McGartland case' Northumbria Police are continuing their wall of silence.They refuse any information in this case and do NOT even keep the victim updated in this case.I'm sure by law they have to keep the victim updated ! A, We advised that the information may be held as we have not yet
attempted to retrieve it. Whilst we are aware that information is held
that may answer your request, we have not attempted to retrieve or review
it at this stage. We have merely assessed that its extraction would exceed
the limits as set by the Act.
B1, & B2, Can you please confirm that you would like this to be classed as
a new request
C1, As it is unlikely that records are held in an easily retrievable
format (if at all) going back 12 years it is difficult to estimate how
long such a procedure would take. However we have been informed that such
an investigation would involve the re-boot of old accounting systems and
the engagement of the IT team with appropriate expertise to verify what
(if any) information is held regarding such requests. This process would
exceed the limits as set by the Act. However, as records going back 6
years are held in a more easily accessible format, it may be possible to
provide further information for that period of time.
C2, Can you please confirm that you would like this to be classed as a new
request
D, As the time threshold had been hit, there was no obligation to respond
to this part of your request. To further assist and close this query our
Finance Team have advised that there are no recorded fixed criteria in
place to request emergency and/or additional funding. Each request for
additional funding is made on an individual case by case basis.

In answer to your queries below:
A. We advised that the information may be held as we have not yet
attempted to retrieve it. Whilst we are aware that information is held
that may answer your request, we have not attempted to retrieve or review
it at this stage. We have merely assessed that its extraction would exceed
the limits as set by the Act.
C1. As it is unlikely that records are held in an easily
retrievable format (if at all) going back 12 years it is difficult to
estimate how long such a procedure would take. However we have been
informed that such an investigation would involve the re-boot of old
accounting systems and the engagement of the IT team with appropriate
expertise to verify what (if any) information is held regarding such
requests. This process would exceed the limits as set by the Act. However,
as records going back 6 years are held in a more easily accessible format,
it may be possible to provide further information for that period of time.
D. As the time threshold had been hit, there was no obligation to
respond to this part of your request. To further assist and close this
query our Finance Team have advised that there are no recorded fixed

We have now had the opportunity to fully consider your request and I
provide a response for your attention.
Following receipt of your request, searches were conducted with the
Finance Department of Northumbria Police. I can confirm that the
information you have requested is held, in part, by Northumbria Police.
However, for questions 1, 2 and 6 for the period 1 June 1999 to 1 June
2000 through to 2005, I can neither confirm nor deny that the information
you have requested is held by Northumbria Police.
Information Commissioners Office (ICO) guidelines state that:
A public authority must confirm or deny whether it holds the information
requested unless the cost of this alone would exceed the appropriate
limit. I can neither confirm nor deny than the information you require is
held by Northumbria Police as to actually determine if it is held, would
exceed the permitted 18 hours therefore Section 12 of the Freedom of
Information Act would apply. This section does not oblige a public
authority to comply with a request for information if the authority
estimated that the cost of complying with the request would exceed the
appropriate limit of 18 hours, equating to £450.00.
You should consider this to be a refusal notice under section 17 of the
Act for that part of your request.
As previously advised in our responses to FOI 499/11 - Emergency Funding,
it is unlikely that records are held in an easily retrievable format (if
at all) going back 12 years it is difficult to estimate how long such a

Although excess cost removes Northumbria Police's obligations under the
Freedom of Information Act 2000, as a gesture of goodwill, I have supplied
information below, relative to your request for the period between July
2010 and July 2011 . I trust this is helpful, but it does not affect our
legal right to rely on the fees regulations for the remainder of your
request.
1. During the period July 2010 and July 2011 Northumbria Police
received emergency/additional funding once.
2. The Force received £449,000 additional funding in relation to
Operation Bulwark (Raoul Moat investigation) from the Home Office.
3. The funding was allocated to Northumbria Police because of the
exceptional nature and scale of the incident.
4. Financial Records in relation to additional funding need only be
maintained for the six previous financial years plus the current financial
year.
5. There is no register kept of financial information/records
destroyed or disposed of. Information/records to be disposed of will be
collected by our waste management contractor. Any Information considered
of a confidential/restricted nature will either be:-
- shredded on site by Northumbria Police staff before being
disposed of by the waste contractor.
- shredded by the Contractor on site (Northumbria Police).
6. For the period 2005 to present, no information held.
The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must
be strictly in accordance with the Copyright Designs and Patents Act 1988

I have again liaised with the Finance Department in order to offer you
further clarification on this matter.
I have been advised that it is impossible to provide an estimate with any
kind of accuracy regarding how long it would take to carry out the task in
question. I have been assured that this would be a substantial piece of
work and it would far exceed the 18 hours allowed under the Act, it was
due to the size and complexity of such a task that an estimate could not
be made.
The re-boot of the old system would initially involve work requests being
submitted to appropriate departments to carry out the research on how to
set about carrying out such a re-boot, then the engaging of suitable
resource with appropriate expertise, then a large re-configuration and
manipulation of any data held would have to take place and then a manual
trawl through that data to attempt to locate anything relevant to your
request. It is these tasks that would mean that limits of both time and
cost would be exceeded.
As previously advised, even if such a task was carried out, it is not
known if those systems would hold the information. In order to answer your
request a manual review by appropriate expertise would have to be carried
out
It may be worth noting that in previous cases the Information Commissioner
has advised that where "manipulation of the raw data to produce requested
information would require levels of skill and judgement " (Johnson v ICO
July 2007) there is no requirement to provide the information.
Having provided further clarification on this request, Northumbria Police
now considers this matter closed.

The Martin McGartland case, according to Northumbria Police, is a 'live' unsolved attempted murder case.
2. Are NP saying they have no records at all concerning the costs relating to the Martin McGartland case? If so, please explaine why given above. Those costs could now be well over £3mil. This is public money.
NP HQ leaked information to the local press in 1999 which was printed on front page of the newspaper. That report claimed that the total costs within the first 6 months or so alone was reported to be £1.5 Mil.

Firstly I have to advise you that records are not kept, nor are they

Your response to your request for review is as follows:
As you have not made out any specific arguments as to why you disagree
with the response you were provided, this review has taken the opportunity
to re-visit and review your request and its response as a whole.
As explained to you in the initial response sent to you, this review can
confirm that there is no requirement to retain this kind of financial data
for that length of time (12 years) and in fact the data (if held) is not
in an easy to retrieve format. The initial response advised you that
section 12 of the Act was applicable to your request. Section 12 of the
Freedom of Information Act 2000 states that an authority is not obliged to
respond to a request if it estimates that the cost of complying with the
request would exceed the appropriate limit of 18 hours equating to £450.00
It has been confirmed with the Finance Team that to simply begin to
attempt to locate the requested data would involve a significant amount of
work. This process would involve the re-boot of old systems and
potentially the engagement of expertise on those systems to find out if
such data was held for the period you requested. Raw data (if it exists)
would then require manual review for the extraction of the information
required to answer your request. It was this process that was fully
explained to you via e-mail 25th August 2011.
It was further clarified to you that whilst the Finance Team had been
contacted, the actual search for such data had not taken place. What had
occurred was merely an assessment of the work that would be involved in
attempting to see if such data existed and could be extracted, this
assessment is a requirement of the Act where section 12 is being
considered. It was therefore impossible to state whether such data could
be extracted, despite your assumption that it had been. As the assessment
concluded that it would take longer than the time and cost limits as
outlined in the Act, there was no requirement to carry out this work. It
is therefore clear that the exemption has been appropriately engaged.
There is a duty under the Act to aid and assist where possible in
providing a requestor with advice and assistance, so far as it is
reasonable to do so, to persons who have made requests. This advice was
offered in the form of providing you with a suggested time period that
could be searched more easily and could therefore be supplied with a
substantive response.
In conclusion, the decision to engage section 12 of the Act was

Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')
Thank you for your email dated 15 November 2011 in which you made a
request for access to certain information which may be held by Northumbria
Police.
As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.
You asked:
"In your latest reply (FOI 809/11 refers) you told me that, 'I have been
advised that it is impossible to provide an estimate with any kind of
accuracy regarding how long it would take to carry out the task in
question. I have been assured that this would be a substantial piece of
work and it would far exceed the 18 hours allowed under the Act, it was
due to the size and complexity of such a task that an estimate could not
be made.'
1. Can you supply me with all details i.e. notes, emails and all
other recorded information which relates to above matter.
2. How do NP account for public money that is spent of cases. Are
NP saying they just dont keep such information? Please suppy all
information on how NP account, record such costs".
In response:
We have now had the opportunity to fully consider your request and I
provide a response for your attention.
Following receipt of your request, searches were conducted with the
Finance Department of Northumbria Police. I can confirm that the
information you have requested is held by Northumbria Police.
I have decided to disclose the located information to you as follows.
1. As some of the information you have requested re emails etc is
accessible by other means I have not provided you with a copy of the
information and will rely on Section 21 of the Freedom of Information Act
2000. You should therefore consider this a refusal for this part of your
request.
I have provided an explanation to this exemption below.
Section 21 (1) - Information accessible by other means
Information which is reasonably accessible to the applicant is
exempt information.

Any other information in relation to your request will not be
disclosed and by withholding we rely on the following exemption:
Section 40 (2) - Personal Information
Section 40(2) is class based absolute exemption and as such
legislators have identified that there would be harm in disclosure and
there is no requirement to evidence this or consider the public interest
test. However, as Section 40(2) is engaged and in order to make the
exemption absolute we need to evidence that a data protection principle
would be breached by disclosure. In this case it would not be fair to
process information which could lead to the identification of an
individual, therefore the first principle of the Data Protection Act
would be breached.
However, this information may be considered for disclosure under
the Data Protection Act via the submission of a Subject Access Form. In
order to aid and assist you, I have provided a link to the relevant area

2. The Force do not cost by individual case. Work by Officers and staff
on specific cases and operations is undertaken as part of normal duties
with no financial record of how time is spent on individual cases being
kept. Officers and staff do not complete timesheets for normal
shift/hours worked. Officer and staff, as well as other non salary costs,
are accounted for based on more general functional areas around the Area
Command and Departmental structures. As such the Force accounts for
public money in major policing areas e.g Area Commands, Crime, ICT etc
rather than specific incidents, cases or operations. Budgets are
maintained and monitored across these functional areas to ensure financial
management of the Force’s resources.
However certain specific cost on large individual cases may be collected
for any "additional" costs incurred over and above normal shifts/working
hours, most typically overtime on major incidents. In these cases a
specific cost centre allocation will be set up against which overtime
costs will be collected and monitored.
The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must
be strictly in accordance with the Copyright Designs and Patents Act 1988
(as amended) or such other applicable legislation. In particular, you
must not re-use this information for any commercial purpose.
How to complain
If you are unhappy with our decision or do not consider that we have
handled your request properly and we are unable to resolve this issue
informally, you are entitled to make a formal complaint to us under our
complaints procedure which is attached.
If you are still unhappy after we have investigated your complaint and
reported to you the outcome, you may complain directly to the Information
Commissioner’s Office and request that they investigate to ascertain
whether we have dealt with your request in accordance with the Act.
