Requests about number of complaints about individual firms

We're waiting for Frances Lewis to read recent responses and update the status.

Dear Solicitors Regulation Authority,

I note from responses on this website from the Legal Ombudsman that it provides data on individual complaints for solicitors' firms and yet the SRA refuses to do so. What is the difference between the LEO and the SRA to allow the SRA to maintain such secrecy? It is in the public interest to understand if there are systematic failings in a firm of solicitors in order to decide whether to use the firm of solicitors. The SRA is supposed to be independent and has its own transparency rules and yet it appears to be shrouded in secrecy.

The European Commission requires decisions on unfair contract terms to be published for the benefit of consumers. Where can we find this information on contracts used by solicitor's firms? Who is responsible for reviewing these contracts?

Dear SRA Information Compliance,

I am not sure that you have answered my question.

If contracts do not comply with the Law (and/or the SRA handbook/ rules) are you saying that they will be reviewed by the SRA and/or Legal Ombudsman and feedback provided? This has not been the case in my experience. The Consumer Protection regulation says there has to be an alternative route to court for consumers where unfair terms are concerned - where is it?

It is not LeO because LeO is only concerned with "poor service".

You are saying that the SRA and Legal Ombudsman have different functions but why is it that the SRA always defers back to LeO, even when there are allegations of fraud and dishonesty (and your website clearly delineates the process).

Yours sincerely,

F Lewis

Dear SRA Information Compliance,

As I said, this is a generic problem - SRA deferring to LeO (or more often the Samaritans). I am not clearly not going to get the answers to my questions here and I have not got them from inside the SRA either. You just don't want to answer the questions. The SRA has my complaint; it knows who I am. Perhaps you could get it to write to me personally Jack, linking my questions to my individual complaint.

Yours sincerely,

F Lewis
