Dear Advertising Standards Authority,
I wish to be provided with copy of the first draught of the findings of your investigation and adjudication of the complaint against direct mail sent to CLA members in the North-East of England in 2006. Your on-line website ( archive ) says the adjudication of 25/07/2007 replaces one from 30? ( full date omissed).
This is in regard of complaint reference- 17080 and l wonder if there is further information within your file for this that would be of assistance to me as someone also sent this somewhat misleading literature as a member of the CLA?

Thank you for your e-mail. The Advertising Standards Authority (ASA) is not subject to the Freedom of Information Act 2000, as it is not a body listed by the Act as being a public authority. The ASA is independent from Government and receives no funding from the taxpayer.

However, we will always try to be as helpful and transparent as we can when answering queries and provide detailed information and responses wherever possible.

The text in the assessment field in the republished adjudication should read:

THIS ADJUDICATION REPLACES THAT PUBLISHED ON 30TH MAY 2007. THE DECISION HAS BEEN REVERSED, MAKING THE COMPLAINT ‘UPHELD’.

I am writing to request an internal review of Advertising Standards Authority's handling of my FOI request 'Requesting Copy of First Draught of Adjudication Complaint Reference- 17080'.
In the letter that accompanied the first draught of the ASA's ruling, there is mention of there having been an internal review that then caused the decision to be changed and republished.
My request is for copy of this additional information to better understand how the issues were addressed differently.

Thank you for your email. We spoke on the telephone this morning and I also responded to your original enquiry on 15 May.

Further to our conversation and your subsequent email, I'm afraid that the ASA will not be conducting an internal review of how it handles FOI requests. I provided you with a hard copy of the original ASA ruling involving Land Registry, which you have received, and that we discussed at length during your call. Furthermore, as mentioned, we're not subject to the FOI Act. We do, however, aim to respond as helpfully as we can to requests for information.

To clarify, the original version of the ruling that I sent you makes no mention of the Independent Review because that process follows on from the ruling being published.

As I explained on the phone, only once an ASA decision is published can an advertiser or a complainant (who were party to the original investigation) seek a review of an ASA ruling. In this case, the complainant sought an Independent Review and our decision was subsequently overturned. As mentioned in my previous email, the ruling that was published following the Independent Review outlines that: the case has been republished, that it replaces the one published on 30 May and that the decision has been reversed:

"THIS ADJUDICATION REPLACES THAT PUBLISHED ON 30TH MAY 2007. THE DECISION HAS BEEN REVERSED, MAKING THE COMPLAINT ‘UPHELD’."

The 'Assessment' field in the ruling outlines why the ASA has found the ad in breach of the Advertising Codes.

While we can't share private correspondence between the Independent Reviewer and the ASA, the Independent Review process enables the complainant or advertiser to challenge the ASA's decision. The Independent Reviewer, having looked at any new evidence or arguments, then presents a recommendation to the ASA Council for it to consider. On this occasion ASA Council reversed its original decision and put on the public record why the ad had broken the rules.

Dear Advertising Standards Authority,

In the Public' s interest , I am writing to request an internal review of Advertising Standards Authority's handling of my FOI request 'Requesting Copy of First Draught of Adjudication Complaint Reference- 17080'.

I state the grounds for asking this to be because the literature of Land Registry was directed originally to target what in affect is an organisation ( CLA), that accounts for 50 % of Property / Land Owners in England & Wales.

My point is how could further members of the CLA take issue in such a collussal matter when denied the findings of the first draught of the adjudication of 30 May 2007.

I illustrate for my own case involving Land Registry for the same crucial time frame , that the with held information denied justice through the Courts that Land Registry was later found to have nor complied with the Data Protection Act and was in fact found to have breached said Act.

By not offering assistance to reveal what amounts to information that would help so many cases , why is the ASA in denial of their role?

The title - The Advertising Authority - appears to state they are a reliable authority that the public can trust. How can there therefore be ignoral of such an important subject of home ownership and Land Registry not having to inform UK Citizens of problems with over-riding interests, which bascially is the mis- selling of products resulting in organised fraud?

Firstly, I'm sorry for the delay in responding to you. I was on Annual Leave.

I'm afraid that we can't help further. I have sought the views of senior colleagues who support this view.

We have provided you with a copy of the original adjudication involving the Land Registry (A06-17080) and explained the Independent Review process. We've also explained that we can't provide you with copies of private correspondence between the Independent Reviewer and the advertiser and complainant during his review. The decision of the Independent Reviewer is final.

I'm afraid that we will not be entering into further correspondence in this matter.

Dear Enquiries,

I had put together three documents including the ASA ruling on 25th July 2007 for consideration to various bodies / agencies / Police / my MP, and as a result there has been the addition of a senior barristers opinion and a report from the Parliamentary Select Committee to do with a decade where 20,000 complainants a year had been gagged by the Parliamentary & Health Service Ombudsman " bullying tactics", quoting legislation not appropriate for those circumstances.
Your providing of copy of the first ruling of May 30 th 2007, has now raised other aspects that need researching.
Your denial of the role that the ASA is playing in the accepted ( Serious Fraud Office) corruption at our Land Registry Offices is now in question , because of recorded refusal to assist .
I am wondering what harm this will do to the reputation of the ASA?
