Dear Merseyside Police,

I am contacting you in regards to releasing body cam footage of the officers involved in a call to Ainsdale, Southport during an answer to a call on the 29/11/2023 from 11:59 to 12:34.

This is in regards to complaints from the callers that the officers on sight dismissed direct threats of bodily and property harm/damage from a hooded, unidentified man that presented to the address before the police were called to it that resulted in the family at the house having to give money to the hooded person, allegedly with encouragement/pressure from at least one of the two officers that attended the call to do so.

The family was given the badge number of one of the officers if that is to be required for the request as well as the full address.

The Information Commissioner requires public authorities to ensure that a
Freedom of Information application is fully understood before providing a
response. Where there is ambiguity in an application, public authorities
are required to seek clarification of the information that you require. 
To enable Merseyside Police to meet your request could you please provide

Are you seeking Body Cam Footage of the incident on behalf of yourself or
a third party? If it’s for another party you will need to send in a SAR
request, as this is not held by the FOI Department, but I can only guide
you once you respond to this question

 

I am contacting you in regards to releasing body cam footage of the
officers involved in a call to Ainsdale, Southport during an answer to a
call on the 29/11/2023 from 11:59 to 12:34.

address, name of occupant and Officer’s badge number

 

 

 

After receiving your reply, your request will then be considered and you
will receive the information requested within the statutory time scale of
20 working days as defined by the Freedom of Information Act 2000, subject
to the information not being exempt or containing reference to a third
party.

 

However, if the requested information has not been received by one month
after the above date, I will consider that you no longer wish to proceed
with this request and it will be treated as withdrawn.

 

There may be a fee payable for the retrieval, collection and provision of
the information you request. If this is the case you will be informed and
the 20 working day time scale will be suspended until we receive the
payment from you. If you chose not to make a payment then your request
will remain unanswered.

As previously explained  your FOI application is not a valid FOI request.
I appreciate your asking for Personal Information regarding a family
matter but unfortunately the family members involved need to make a SAR
Request, or you can on their behalf but with the involved parties written
consent- both parties will need to attach two forms of ID. If you read my
Response Table the link in Bold  SAR (Subject Access Report) is the
Department you need to submit your request to. In regards to the BWV
incident you can pursue this by completing a  complaints form. I have
attached the link for you to proceed with
