Dear Flintshire County Council,

A meeting was conducted at 1030hrs on 22nd February 2018 over unlawful development for Planning Application 052513. Flintshire County Council Planning Department, Flintshire County Council Planning Enforcement, Flintshire County Council Legal Department, Local Ward Councillors, Council Member for Planning and Public Protection, and the occupant of No5 Dawn Close and the undersigned were present.

A further meeting was conducted over unlawful development for Planning Application 052513 between Flintshire County Council Planning Department, Flintshire County Council Planning Enforcement, Flintshire County Council Legal Department, the Developer and the Construction Company. The date and time of this meeting is unknown.

Pursuant to these meetings, a formal decision was to be made within 21 days over this unlawful development, with a target date of 15 March 2018. This decision is still not forthcoming.

Minutes of both these meetings are requested.

As these are formal minutes to an important meeting, it is crucial that they portray accurately what was said and do not include omissions.

Point 1 - Omission. Apologies: Mrs Mandy Lewis - Development Control Manager

Point 2 - Incorrect statement. It is stated by Mr Bellis that the removal of the hedge reduced the separation distance. This was not stated and is against the Laws of Physics. It was stated the removal of the hedge substantially weakened the case for the shortened separation distance as this was a mitigating factor to reduce the separation distance from the minimum 22m to 18.5m presented to the Planning Committee.

Point 3 - Incorrect Statement. I did not question whether Land Registry Titles were provided. I have had all of these documents for some years. I referred to Section 60 of the Land Registration Act 2002 which states it shows general boundaries only.

Point 4 - Incorrect Statement. I dispute the word aggressive was used. Apologies were extended for a "heated" exchange by telephone borne through frustration at being continually ignored and told the measurements by the Planning Officer were correct. It has taken over a year for the Planning Department to admit the distance is not 18.5m but 16.3m.

Point 5 - Omission. Flintshire County Council Solicitor asked Mr Bellis if he was open to negotiation on the matter and what did he want out of the meeting. This led to a conversation regarding a reduction to single story bungalow in place of a 2 storey semi detached block.

Point 6 - Omission. It was also stated that a further meeting would take place between Planning, Legal and the Developer.

Point 7 - My attached handout and bullet point notes were given to aid Ms K Jones in the writing of the formal minutes due to the number and complexity of points which I raised. If I had known that they were to be included as an Annex to the minutes they would have been typed in a more formal manner.

Dear Lesley Matischok,

After a meeting with FCC Planning Department and FCC Legal, written correspondence indicates that FCC have finally admitted after over a year, that the measurements submitted to the Planning Committee were incorrect and that the measurements submitted by the undersigned were, in fact, correct.

The decision by FCC to allow the continuance of this development uses an online accuracy disclaimer by Ordnance Survey (OS) to allow them scope to vary any planning application by 2.5m!

If this is used in conjunction with what is normally deemed as a non-material amendment in relation to the move of a development within a site of up to 1m, it allows FCC the legal power to vary build site positions by up to 3.5m and bypass the need for a submission of a material planning amendment in any subsequent developments.

It is my belief that the individual responsible for the error will not be made accountable as any subsequent action by FCC against the developer would open the door to compensation. This considerable financial burden to FCC would be directly attributable to the individual who has made this error, hence the decision by FCC to disregard the material harm caused by loss of privacy and loss of residential amenity.

I am most disappointed.
