We have now discussed your request with the Head of Planning and Economic
Development and he is perplexed as to what you consider is missing from
our response.  If you can clarify further then we can attempt to find the
information if it is available.
 
It may be something that the Developer's director & hydrologist stated,
any further information you can provide might help us to understand what

Is the flood risk for the Kingspark site really based on information for the WRONG SITE?
Where is the information I asked for? here are no diagrams or flood information included with the engineer's report, which renders them meaningless.
Why did you send me information for the wrong site?

I'd already asked for a review of this - and Mr Hamilton said he was 'perplexed' - and suggested I was confused about who said what. I really don't think it's me who is confused!!

I refer to your email dated 15 ^ February 2018 in which you requested the

The Legal Manager’s response

 

On 20 March 2018 the Legal Manager responded to your request stating that:

 

“We have considered your request under the Environmental Information
(Scotland) Regulations 2004 (‘the EIRs’). The answers to your questions
are contained in the documents attached.

 

 1. Please provide us with all information/communication between DCC
planners and any other authority, body, individual etc regarding
water, flood risk, drainage or any other environmental conditions
relating to the Kingspark site, Gillburn Road - since the planning
application went in.

 2. Same request to DCC engineers.

 3. Please provide us with the dates of the EIA screening and opinion
documents published on the Planning Portal. The Screening Opinion was
completed on 9 November and published on the portal on 21 November.

How We Handled Your Request

 

We believe you have asked for environmental information as defined in the
Environmental Information (Scotland) Regulations 2004 (‘the EIRs’), so we
are dealing with your request under those regulations. To be able to use
the EIRs, we must apply an exemption under section 39(2) of the Freedom of
Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information
Commissioner’s guidance recommends that public authorities apply this
exemption to environmental information and handle requests under the EIRs.

Your request for Chief Executive review

 

On 20 March 2018 you requested a review of the Legal Manager’s response
stating that:

Clarification

 

The Freedom of Information Liaison Officer sought a clarification from you
to as to what information you considered missing from the Legal manager’s
response.

 

On 4^th^ April, you responded stating: “No cause for perplexion...   I
just wanted to ensure that the Head of Planning was not basing comments on
any information I was unaware of.  
If I have been provided with the entirety of information you hold, that is
fine.”

 

On the basis that you were satisfied by the information initially provided
to you, no further action was taken in relation to your original request.

 

On 11^th^ April 2018, you requested a further Chief Executive review. In
your email you stated that:

The Legal Manager’s response to your request for review

 

I would firstly like to clarify that the information provided to you in my
original response relates to the site at Kingspark. The only exception is
the engineer’s report to a planning application at Dundee College which
was included in the documents sent to you in error. I apologise for any
confusion caused as a result of this.

 

With regards to your aforementioned clarification and request for diagrams
and additional information related to flood risks, please find enclosed
supplementary documents which provide this information.

 

To further assist you, our Planning Officers are also happy to meet with
you to discuss your request further.  

My Conclusion

 

I hope that the additional information provided is helpful to you and
satisfies your original request. The offer from the Planning Officers to
meet and discuss matters should assist in clarifying your enquiry such
that the relevant answers you consider you need could be made available.

 

If you are unhappy with my decision, you may appeal to the Scottish
Information Commissioner.  You must submit your appeal to the Scottish
Information Commissioner within six months of receiving my decision.

Dear Dundee City Council,

I'm not sure why I would need to talk to the planners. I made a straightforward request for information and it has taken several attempts & an internal review to get the information I clearly asked for in the first place!

I will also need to put in yet another FOI request as the Planning Officer did not bother to respond to my request to send me one document. I have waited 6 weeks with no response whatsoever - even though I did point out it would be more efficient than me having to put in another FOI request...

How much time & money could Dundee City Council save by simply providing people with the information that they are entitled to see, rather than this grudging dripping tap approach?
