I am writing to request an internal review of Warrington Borough Council's handling of my FOI request 'Request for Paperwork in reespect of Items 13 & 14 at the Executive Board, January 16 2017'.

I believe your reply is confusing and erroneous.

At one point it states, "We are unable to provide the information requested in relation to Executive Board item 13 and 14, for the meeting that took place on Monday 16 January 2017, as they were both considered as Part 2 item (confidential or other special nature)." This suggests that the causation of the refusal is that the papers I requested were exempt information in January 2017. That is not a valid reason for refusing the request because although it demonstrates that at the date of the meeting the Council's chief legal officer judged the material to be exempt, such an exemption is not permanent. Information is only exempt information if and so long, as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

The response then, contradictorily, states that the refusal of the request is justified by reference to Section 21 of the Freedom of Information Act 2000 (FOIA) because it provides that information is exempt from the requirement of disclosure under section 1 of the Act where that information is reasonably accessible to the applicant by another means or route, and refers refers me to the minutes of the meeting. I have read the minutes which, far from providing the documents requested, quite deliberately provide only a brief and incomplete summary of the specific information I requested precisely because, at the time of the meeting the information was exempt (see above).

Please review your decision and, if in the opinion of the chief legal officer the reasons for exemption in 2017 have been affected by the passage of four and a half years, issuing the papers I requested, even in redacted form if necessary.
