I am sorry that you have found it necessary to contact us about your
information request.  I see from the “What do they know” website that, on
25 January 2017, you asked:

 

“Would you please send me a full and up to date list of all licensed
premises in East Lothian? Please include the name of the Premises License
Holder and Designated Premises Supervisor/Manager.”

 

Unfortunately, your correspondence does not appear to have reached us and
I have asked our IT team to look into this.

 

I confirm that East Lothian Licensing Board will be happy to assist you
with this matter.  In order to begin processing your request, however,
please provide your full name.  Under the Freedom of Information
(Scotland) Act 2002, requests for information are only valid if the
applicant provides their real name and a contact address.  I have provided
an extract from the website of the Scottish Information Commissioner for
your information: 

 

[1]Do I have to provide my real name and my full address when I ask for
information?

 

The FOI Act says that a request must include the name of the applicant and
an address for correspondence. In terms of your address, either your full
postal address or your email address will be fine.

 

You will need to provide your full real name. If you don't use your real
name the authority won't have to provide the information, and you won't be
able to appeal to the Commissioner. At the very least, your request should
include your initial and your surname.

 

If you send your request by email, remember to put your name in the text
of the email. Even if your name appears in your email address (e.g.
[2][email address]) you must add your name to the text of your
request, so that it is clear who the email is from.

 

Upon receipt of this information I will register your enquiry and refer it
to the appropriate department for action.

On behalf of East Lothian Licensing Board I am now able to provide the
information you require; please refer to the attachment.  I am sorry for
any inconvenience you experienced when originally submitting your request
but I hope that this information will be of interest to you.

 

Under the terms of this legislation, if you are unhappy with the way your
request has been handled, you are entitled to request that we undertake an
internal review.  Please note, however, that both the Freedom of
Information (Scotland) Act 2002 and the Environmental Information
(Scotland) Regulations 2004 only relate to the release of information. 
The Scottish Information Commissioner publishes the following guidance
about internal reviews:

 

You can ask the authority to review its decision if it does not respond or
you are unhappy with the way it has dealt with your request, for example
by:

 

·                     refusing to give you the information

·                     failing to reply to you within the time limit
allowed

·                     claiming the information is exempt

·                     failing to give you advice about, and help with,
making your request

·                     asking you to pay a fee that you feel is
unreasonable

 

For example, if you are unhappy because you do not believe the information
you have received is accurate, an internal review would not apply.  Should
this be the case, however, please let me know and I will try to resolve
this.  If I am unable to help, I will be happy to put you in touch with
someone who can.

 

We must receive a request to review within 40 working days of the date of
this notice.  A request to review our decision must be in writing (e-mail
is acceptable) or another permanent format.  When writing, you should
include your reasons as to why you are unhappy with our response and why
you wish it to be reviewed.  Your reasons for dissatisfaction must relate

the Commissioner within six months of receiving the review decision.  You
