Request for information Whitehaven Academy

Response to this request is long overdue. By law, under all circumstances, Cumbria County Council should have responded by now (details). You can complain by requesting an internal review.

Dear Cumbria County Council,

Question 1 -please can you send to me all information pertaining to the transfer of ownership of land of the Whitehaven school/academy with regards to the Bright Tribe Trust and affiliates.

Question 2 - can you send me all deeds and/or transfer of ownership.

Question 3 - do council still own the land including playing fields.

Question 4 - who now owns the land.

Question 5 - if asset transfer please can you send me all details regarding the asset transfer and costs for transfer.

Question 6 - if/if not asset transfer, how much rent is paid per annum including VAT to the current user.

Question 7 - if asset transfer or rental, who is the user.

Question 8 - if asset transfer or rental what are the terms and conditions of use.

Question 9 - How long is the asset transfer or rental.

Question 10 - who is your main point of contact with regards to asset transfer or rental of the Whitehaven school/academy land.

Question 11 - please send me all correspondence between county council and the person/s mentioned in question 10.

Question 12 - please can you send me all correspondence, emails, letters etc pertaining to contact or discussions with the person/s identified in question 10.

Question 13 - please can you send me all correspondence pertaining to discussion between Whitehaven Academy/school and Copeland borough council and cumbria county council between December 2014 and today's date.

Question 14 - whether asset transfer or rent please can you send me a breakdown of all payments or arrears of payments from the current user.

Question 15 - what responsibility and duty of care do County council have over duty of care and welfare of students in this school.

Question 16 - can you send me all minutes of Cumbria County council meetings where discussions have been had regarding the Whitehaven Academy from December 2014 to today's date.

Thank you for your request for information regarding the transfer of
ownership of land, which was received on 01 August 2016.

 

The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 31 August 2016. 
Subject to the information not being exempt or containing any references
to third parties.

 

The council will, as a matter of routine make information available in
electronic format.  Where it is not practical to do this information will
be provided in hard copy (paper).  If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.

 

The Freedom of Information Act 2000 and Environmental Information
Regulations 2004 define a number of exemptions/exceptions which may
prevent information being released to you automatically.  The council will
make an assessment about the application of any exemptions/exceptions and
issue you with a decision letter, which will include details of your right
to appeal.

 

If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.

 

In accordance with the council’s [1]Charging Policy a fee may be charged
for supplying information.  If a fee is payable you will be issued with a
fees notice.  The applicable fee must be paid in full before the
information is processed and released.  The statutory time limit for
responses is suspended until the council has received and processed your
payment.  If payment is not received within three months of issuing the
fees notice your request will be closed.
