Request for Information related to Tree Felling Protests

Sheffield City Council did not have the information requested.

Dear Sheffield City Council,

Re Youtube Video 'Protesters Have No Respect For Democracy' youtu.be/a5ak_V8RS7s

The above video contains footage that was captured in and around tree felling sites in Sheffield.
SCC website stated that images would be collected for the purposes of the Injunction against tree felling protests.

Please can you comfirm the following.
1. Who is the Data Controller for footage /images collected in and around felling sites by SCC, Amey, StreetsAhead, Servoca, Acorn EMG or other individuals and organisations?

2. Please provide a copy of the SCC 'Data Processing Policy' that allows the sharing of personal data / images from SCC and or partners for use in publically published media.

3. Please provide all communications, notes, minutes held by SCC, Amey and partners or relevant individuals and organisations in relation to the production and release of the video.

4. Please provide copies of all 'Invoices' and or 'Purchase Orders' in relation to the production and release of the video held by SCC, Amey and partners.

5. Please provide the name(s) of any SCC Departments, Partners, Organisations or Companies that were involved in the production and/or release of the video.

Thank you for your recent request for information regarding Information
related to Tree Felling Protests, which we received on 31^st July 2019.  I
apologise that this response is later than it should have been.  The
summer months are always challenging for FOI requests as many staff are on
annual leave.  I hope that this has not caused you an inconvenience.

 

Please find below, Sheffield City Council’s response to your request:

 

1.  Who is the Data Controller for footage /images collected in and around
felling sites by SCC, Amey, StreetsAhead, Servoca, Acorn EMG or other
individuals and organisations?

 

SCC and Amey are joint Data Controllers of footage and images taken in and
around the felling sites for the purposes of gathering evidence for legal
proceedings.

It is possible that Amey may be a sole Data Controller of any other
footage which they gathered for other purposes, but you would need to
approach them for this information.

 

Regarding the other organisations and individuals you have referred to, we
cannot comment on whom the Data Controller is for any other footage/images
taken by any other organisations or individuals.

The Data Controller is the person, legal or individual, who determines the
purpose of the processing, so in this instance the Data Controller would
most likely be the person or organisation who took the footage/images or
the person or organisation for whom the footage/images was/were being
taken.

 

2.  Please provide a copy of the SCC 'Data Processing Policy' that allows
the sharing of personal data / images from SCC and or partners for use in
publically published media.

 

We do not have a specific “Data Processing Policy” but we would not
normally share footage/images for use in published media unless there was
consent or a legitimate reason.

 

3.  Please provide all communications, notes, minutes held by SCC, Amey
and partners or relevant individuals and organisations in relation to the
production and release of the video.

4.  Please provide copies of all 'Invoices' and or 'Purchase Orders' in
relation to the production and release of the video held by SCC, Amey and

Many thanks for your reply.

It is my understanding that Amey, as a partner organisation with SCC, are liable to FOI request via SCC and I would have thought that the information would have been requested from Amey to complete the request.
If I am mistaken could you please supply the contact details for a department within Amey that will address my questions.

You are right that Amey are a partner organisation. However, FOIA only applies to information held by others if this is held on behalf of the local authority. Any information that Amey holds for their own purposes would not be covered by FOIA.

Dear FOI,
As Amey is a partner organisation with SCC and the images and video are directly related to the publicly funded Streets Ahead programme on behalf of SCC I can't understand why Amey fall outside of the FOI request.

Would you be able to make enquiries or forward the request as a gesture of good will?

Thank you for your email. As we have explained in our previous responses, any footage which Amey holds for their own purposes, for example for the purposes of protecting their staff, would not be covered by FOIA.

We would be happy to forward your request onto Amey but please be aware that Amey are not a public authority and as such are not subject to FOIA. Please also be aware that Amey are not under any obligation to respond to queries from members of the public.

If you would like us to forward your email to Amey, it may be helpful for you to provide us with an alternative email address, as we believe that Amey might be more likely to respond to an individual rather than to an email submitted through the whatdotheyknow website.
