Request for information regarding a publicly accessed road (Buntingsdale Road, Market Drayton)that is blocked by a gate and padlock
Dear Shropshire Council,
I would like further information, through a Freedom of Information request, regarding a road between Buntingsdale Park in Tern Hill (Tayleur Drive) and the area known as Little Drayton which is accessed via Buntingsdale Road.
Buntingsdale Road runs past the Hall and is demarked by white lines and an old speed limit that is seemingly illegible. However at the point by a cottage near the Hall, a physical barrier that is padlocked and chained has been implemented in the past five years that has completely restricted access for all vehicles through to the residential estate.
According to all sat navs and mapping software, this road is still accessible as a through road for vehicles and residents. We are told that the new residents of the cottage have, in the last several years, closed the barrier and installed a padlock to stop all traffic driving past despite the fact that the barrier is not on their driveway but across the road itself. With this road being still labeled accessible as a through road, delivery vehicles and ambulances attending as rapid responders to emergency events within the housing estate of Buntingsdale Park may find it difficult to attend residential properties. This in turn could cause unwitting deaths.
Therefore, it is my question: has this barrier that has been closed permanently to vehicular right-of-way been done so legally as it is not a barrier to someone's drive but a barrier to restrict a right-of-way?

Dear Mr Buckley
Thank you for your information request which has been passed to myself as
our department manages the public rights of way for Shropshire.
I can confirm that having checked our records and the Highway layers the
route to which you refer is private and has no legally recorded public
status.
Therefore there are no public rights of access of any status along Tayleur
Drive so any barrier will be legitimate.
I have attached a plan showing the legally recorded public rights of way
in this vicinity for your information.
I trust this information assists.
