applies that requires the consideration of the Public Interest.

Walsall Council takes its obligations under this legislation extremely
seriously and I am sorry that in this case we have not met this timescale.

I would like to take this opportunity to assure you of our best
intentions in this regard. I can confirm that we aim for a full reply to
your request to be sent to you on or before 03/03/2022

If you have any queries in regard to this process, please do not hesitate
to contact us.

Dear A.G. Emmanuel,

Freedom of Information Request RFI-4078-22

Further to your request for information about provision of services,

I’d like to request some information in regards to the following
services.

Listed Services:

a) Laundry equipment supply, maintenance and install.

b) Fire equipment supply, maintenance and install and provision of Fire
Risk Assessments / consultancy.

c) HVAC equipment supply, maintenance and install.

d) Catering equipment, maintenance and install.

1)    Please confirm your annual spend for the listed services showing a
breakdown of contract value and any additional ad-hoc spend for the
previous 3 years.

I can confirm that in accordance with section 1 (1) (a) of the FOIA that
the information requested is held by the authority.

However, section 12(1) FOIA provides that section 1(1) (General Right of
Access to Information) does not oblige a public authority to comply with a
request for information if “the authority estimates that the cost of
complying with the request would exceed the appropriate limit.” Any
estimate must be made in accordance with the limits set in the Fees
Regulations made under Section 12 (5) of the Act.  These Fees Regulations
(SI2004/3244 Freedom of Information and Data Protection [Appropriate Limit
and Fees] Regulation) allow for a refusal where the cost of compliance,
for non-central public authorities such as the Council would exceed £450
(equivalent to 18 hours of work).  In estimating the cost of complying
with a request for information, an authority can only take into account
any reasonable costs incurred in:

(a)          Determining whether it holds the information;

(b)          Locating the information, or a document which may contain the
information;

(c)           Retrieving the information, or a document which may contain
the information, and;

[ ]

(d)          Extracting the information from a document containing it

For the purposes of the estimate the costs of performing these activities
should be estimated at a rate of £25 per hour.

The reason for believing that the appropriate limit would be exceeded in
respect of this request is that due to the way work and specialism overlap
it will exceed the time to break down the costs into the separate elements
requested.     Please consider this notice to constitute a refusal notice
on this particular aspect of your request under section 17 of the Freedom
of Information Act 2000.

However estimates have been provided.

process or awarded via framework.

to low volume of requirements

(tender)

i) Please confirm the incumbent supplier and expected retender date.

works through.

for procurement of the above services.
