• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

• What are the contractual performance KPI's for this contract?
· Percentage of in and out of hours’ emergency calls responded to
within the response time defined in the Highways Infrastructure Asset
Management Plan (HIAMP)
· Percentage of Cat 1 orders completed within agreed timescales, as
defined in the Highways Infrastructure Asset Management Plan (HIAMP)
· Percentage of schemes delivered to the agreed programme dates
· Percentage of schemes delivered within +3%/- 10% of agreed target
costs
· Lost Time Incident Frequency Rate (LTIFR) To measure the employee
time lost following an Incident per 100,000 hours worked.
· Output achieved for budgeted spends based on year start target.
· Cumulative actual annual costs within % of total target costs
agreed per year (annual programmes)
· Stakeholder Survey – to be agreed during mobilisation
· Percentage of Cat 2 orders completed within agreed timescales, as
defined in the Highways Infrastructure Asset Management Plan (HIAMP)
· Percentage of cyclic maintenance activities delivered to the
agreed programme
· Percentage of Precautionary Treatment runs completed within the
target detailed in the Winter Service Plan & Highways Infrastructure Asset
Management Plan (HIAMP)
· Number of Defect Certificates as % of total number of Task Orders.
· Percentage of non-compliance which would have resulted in an FPN
as a proportion of all Street Works Notices that commenced in the
reporting month
· Accident Frequency Rate (AFR) To measure the number of reportable
accidents per 100,000 person hours worked. Reportable accidents are those
as defined in RIDDOR regulations prepared by the HSE.
· Recycled Construction Waste, Percentage of arisings recycled into
usable construction material
· Audit failures in Open Book Costing Mechanism (OBCM) - % value of
the audited value where audit discovers an error in any cost categories
(Plant; Labour; Materials; Sub Contractors; Overheads).
· Percentage of final accounts for projects that are submitted
within 3 months of completion
· Delivery with the agreed annual Cultural Improvement Plan (CIP)
targets

The remainder of this question has been refused under the following
section of the Freedom of Information Act:
43(2) Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it).
Section 43(2) exemption for commercial interests is engaged as disclosure
of the information would be likely to harm the interests of the relevant
parties by revealing commercially sensitive information to others.
This is a prejudice-based exemptions which means the authority is required
to consider the harm before deciding whether or not to disclose the
information.
Disclosing information relating to unsuccessful tender bidders would
prejudice the suppliers as this knowledge would benefit competitors,
potentially to the detriment of the suppliers.
This is a qualified exemption which means the authority is required to
consider the balance of public interest before deciding whether or not to
disclose the information.
Public interest considerations favouring disclosure
There is an inherent interest within the Freedom of Information Act that
public disclosure promotes better government through transparency and
accountability.
There is a strong public interest in ensuring the council secures the best
services for the council and that public money is spent appropriately.
Public interest considerations favouring withholding the information
Prejudicing the commercial interests of certain players in the market
would distort competition in that market, which in itself would not be in
the public interest.
Revealing commercially sensitive information such as unsuccessful tender
bidders may discourage suppliers from co-operating with the council in
future if they feel their information will become in the public domain.
This would hamper the council’s ability to provide value for money or
commission the best services for residents.
We have provided remaining details of the contract fulfilling the public
interest.
Overall, we feel that the balance of public interest lies in preserving
commercially sensitive information to enable the council to secure quality
services in the future.
