I would like to request the following:
Copies of the materials / videos provided by each of the organisations

Under section 1(3) of the Freedom of Information Act 2000 ("the Act") we
reasonably require further information in order to identify and locate the
information that you require.
 
On 9 July 2021, you raised the following request:

"In Early Feb 2021, the EHRC solicited 'board briefing materials' from a
number of 'gender critical' organisations in relation to the 'issues
relating to transgender people' for a Board Briefing Session.

I would like to request the following:
Copies of the materials / videos provided by each of the organisations
Copies of any Documentation (including meeting notes, minutes, action
plans) relating to this briefing.

I would also like to ask whether any of the following specific
organisations (or any other trans supportive, LGBT organisation) were
asked to provide 'board briefing materials' for the same (or separately
held) session:

Stonewall, LGBT Foundation, Mermaids, Gendered Intelligence, Trans Actual

and if so:
Copies of any communications requesting such materials"

We responded to this request on 7 September 2021.
 
On 9 February 2022, your colleague 'S' raised a related request containing
the following sentence:

"My colleague Claire Prosho made me aware of an email that you instructed
to be sent to LGBA Alliance on the 8th of February 2021 (copy attached).

In her Freedom of Information request, Claire made it clear she wanted all
correspondence in regard to the Board Briefing on the 9th of February
2022.

While you did provide some details it is apparent that EHRC (perhaps in
error) "held back" on releasing everything."

We responded to S on 9 March 2022 confirming that we "provided all of the
briefings which we were sent and which were seen by the Board."

There seem to be a considerable overlap between your previous request, S's
request, and this current request. With that in mind, we would be grateful
of you could confirm what new information you require and/or whether you
require us to clarify something we explained to you previously.
 
We will not be able to take this matter further without this extra
information from you. If we do not receive appropriate clarification by 5
May 2022; we will deem this request to be closed.

There is zero overlap with previous requests as is perfectly clear - I require information in relation to only those organisations named, as follows:

Please note that I shall also be submitting a complaint to the Information Commissioners Office as there is a clear pattern of the EHRC delaying providing information and refusing to provide information on nebulous grounds.

This request is being handled under the Freedom of Information Act 2000.
 
We confirm that the Equality and Human Rights Commission does hold
information covered by your request; however we consider that the Section
36 'Prejudice to the effective conduct of public affairs' exemption
applies.
 
As this is a qualified exemption we need to carry out a public interest
test to balance the public interest in disclosing the information against
the public interest in withholding it.
 
The Freedom of Information Act 2000 obliges us to respond to requests
promptly, and in any case no later than 20 working days after receiving
your request. However, when the public interest test is engaged, the Act
allows for the time to respond to be longer than 20 working days, and a
full response must be provided within such a time as is reasonable in all
the circumstances of the case. We do, of course, aim to make all decisions
within 20 working days, including cases where we need to consider where
the public interest lies in respect of a request for exempt information.
In this case, however, we have not yet reached a decision on where the
balance of public interests lies.
 
We estimate that it will take an additional 20 days to take a decision on
where the balance of the public interest lies. Therefore, we will respond
to you by 9 June 2022

Dear Information Governance team,

Hi

I fail to see why this would now need to meet 'need to carry out a public interest
test to balance the public interest in disclosing the information against
the public interest in withholding it' given that you have previously provided this exact same type of information in relation to the Board Briefing in regards to other submissions, which would indicate that there are no issues in this regard.

Please provide the requested information immediately on this basis.
